Ml. ~° <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 70-185 <br />BY : ~~~ . Ls~ , <br />A RESOLUTION AUTHORIZING THE MAYOR <br />TO DEED CERTAIN LANDS TO THE STATE <br />OF OHIO CONTIGUOUS TO PROPERTY USED <br />BY THE CITY OF NORTH OLMSTED AS A <br />" WALK-IN PARK " BUT OWNED BY THE <br />STATE OF OHIO, AND DECLARING AN <br />EMERGENCY . <br />WHEREAS, the City of North Olmsted and the State of Ohio entered into <br />an agreement whereas certain State owned real property is to be used by the City <br />of North Olmsted as a "Walk-In Park"; and <br />WHEREAS, under the agreement with the State of Ohio the City of North <br />Olmsted acquired other lands contiguous to the aforesaid "Walk-In Park", under <br />which agreement the State of Ohio shall reimburse the City of North Olmsted for all <br />expenses incurred; and <br />WHEREAS, the lands acquired by the City of North Olmsted are to be <br />added to the "Walk-In Park" to increase the park area; and <br />WHEREAS, the State of Ohio is now going to reimburse the City of North <br />Olmsted for all costs incurred, including the purchase price of the land, upon the <br />City of North Olmsted deeding to the State of Ohio the lands so acquired by the <br />City of North Olmsted; and <br />WHEREAS, Council now wishes to authorize the Mayor to deed to the <br />State of Ohio the property contiguous to the "Walk-In Park" in order that the <br />City of North Olmsted can be reimbursed for monies expended. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section 1. That the Mayor is hereby authorized to deed to the State <br />of Ohio property acquired from: Kruschmeader, Toll and Dillingham, said property <br />being contiguous to and owned by the State of Ohio and known as the "Walk-In <br />Park". <br />Section 2. That the Mayor is further authorized to present to the <br />State of Ohio all costs incurred in acquiring the property from: Kruschmeader, <br />Toll and Dillingham. <br />Section 3. That this Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation. of the public peace, safety, <br />health and welfare of the City by virtue of the fact that these funds to purchase <br />this property were advanced by the City of North Olmsted and are sorely needed <br />in the General Fund to finish the balance of the year.
