,, <br />{{ ~~~ <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 70- /~~ <br />BY ~~~~/• <br />A RESOLUTION MEMORIALIZING THE STATE <br />LEGISLATURE TO AMEND THE PROVISIONS OF <br />SECTION 3773.24 OF THE OHIO REVISED CODE <br />RELATIVE TO TRANSACTION OF BUSINESS ON <br />SUN DAY. <br />WHEREAS, Section 3773.24 of the Ohio Revised Code, relative to the <br />transaction of business on Sunday, is strictly enforced in some portions of the <br />state and is totally ignored in others ;and <br />WHEREAS, enforcement could more easily be achieved if certain changes <br />were made in the law ;and <br />WHEREAS, the Council of the City of North Olmsted desires uniform appli- <br />cation and strict enforcement of any laws of the State of Ohio . <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. The Ohio General Assembly is hereby requested to amend <br />Section 3773.24 of the Ohio Revised Code by <br />(a) Exempting from its operation <br />1. The preparation, sale and serving of all food products <br />and the sale of all perishable items used in the prepa- <br />ration of food ;and <br />2. The operation of a service station or car washdeemed to <br />be included in the meaning of Subsection (a) of Section <br />3773.24 of the Ohio Revised Code, "traveling or providing <br />services or commodities incidental thereto". <br />3. The sale of prescription and non-prescription drugs, <br />medicines and items incidental thereto, including <br />hygienic products, pharmaceutical preparations and <br />products, first aid items and cosmetics, to the greatest <br />degree constitutionally and legally possible ; <br />(b) Providing for municipal licensing of all businesses legally <br />operating on Sunday ; <br />(c) Providing a fee for licensing to be returned to the municipality <br />to help defray enforcement expenses ; <br />
