L a ~ K <br />70-39 <br />- 2 - <br />therein, expenses of legal services including obtaining an approving legal. opinion, <br />cost of labor and material and interest on beds snd notes issued in anticipation <br />of the levy and collectic~a of the special assessments together xith all other <br />necessary expenditures. <br />`' ~ Section 6. That the City Engineer is hereby authorized and directed to <br />prepare and file in the office of the Clerk of this Council the estimated assess- <br />ments of the cost of the imprav~ent described in this resolution. Such es- <br />timated assessments shall be based upon the esti~,te of cost of said improvement <br />now oar file in the office of the Clerk of this Council and shall be prepe-xred <br />pursuant to the providicaa3a of this reaaolution. i~en such estimated assessments <br />have been so filed, said Clerk ahal.l cause notice of the adoption of this resolu- <br />tion and the filing of said est3aarated assessments to be served on the owners of <br />all lots and lands to be assessed as provided in Revised Code Section 727.13. <br />Section 7. That the assessments to be levied sha11 be paid in five annual. <br />installments, xith interest can deferred payments at the same rate as shall be <br />borne by the bnds to be issued in anticipation of the collection thereof; pro- <br />vided, that the owner of any property assessed may, at his pption, psy such <br />assessment in cash within thirty days after passage of the assessing ordinance. <br />Section 8. That bonds of the City shall be issued in anticipation of the <br />collection of assessments by installments and in an amount equal thereto aril notes <br />of said City shall be issued in anticipation of the issuance of such bands and <br />the levy of such assessments. <br />Section 9. That the remaining cost of said improvement, after application <br />of the assessments herein provided, shall. be paid by the issuance of bonds in <br />the manner provided by lax or from other funds available for this purpose. <br />Section 10. This resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health and. safety <br />of said City and for the P~u*hher reason that the immediate construction 'of said <br />sidewalks is necessary to elimihate existing hazards to pedestrian, traffic using <br />said streets, wherefore, this ree+~lution shall be in full force and effect from <br />and immediately after its passage and apprcnral by the l~yor. <br />PASSED: <br />AT'P~ST: <br />APPROVED: _ _ .... 7~ <br />_._._._ <br />s awn, syor <br /> <br />.. ure~r~ixn,~~arc<, <br />
