~~ <br />CITY OF NORTH OIMSTED <br />ORDINANCE No. -/ 3 <br />~~ <br />a <br />AN oRDINA~ ~NIr~ TO PAC)C~'D WITH TSP cc~- <br />sT~r~rleN Q~ si~uxs oN ~vT Rr.E Rcu~D, AND <br />DECIARII4G AN ENCY . <br />BE IT ORDAINI~D by the Council of the City of North Olmsted, Cuyahoga County, <br />Ohio: <br />Section 1. That it is hereby determined to proceed with the constru~ctioa <br />of concrete sidewalks oa the south side of Butternut Ridge Read bet~en Fitch <br />Road and a point 1393.11 feet easterly thereof in those locatiaas where the <br />property c~ners did not construct sidewalks pursuant to the optical contained in <br />Resolution No. 70-98, adopted June 2, 1970. <br />Section 2. That said sidewalks shall. be cohstructed in accordance with the <br />provisions c>f Resoluti~ No. 70-98 adopted June 2, 1970, and with the pLxns, <br />specifications, estimates and profiles heretofore approved end now an file in <br />the office of the Clerk of Council. <br />Section 3. Subject to the provisions of Section 727.2, Devised Code, the <br />Mayor of the City is hereby authorized and directed as soap as the funds therefor <br />are available to make and execute a contract for said improvem~snt with the lust <br />an8 best bidder after advertising according to law and the improvement shall be <br />financed as provided in the resolution of necessity. <br />Section ~. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within fifteen days after its <br />passage. <br />Section 5. This orrc]3.nance is hereby declared to be an emar®ency measure <br />necessary for the immediate preservation of the public peace, h~.1.th and safety <br />of said City and for the Further reason that the immediate preeervatic~n of the <br />public peace, health and safety of said City and for the further reason that the <br />immediate construction of said sidewalks is~necessary to eliminate existing 'hazards <br />to pedestrians using said street; wherefore, this ordinance shall be in fu11'force <br />and effect from and immediately after its pe~ssage and approval by the Mayor. <br />PASSED: <br />ATTEST: <br />APPROVED: <br />~i~e_aa <br />or <br />p E G ri ,May <br />~~-~ ~JY7e <br />C~2.~t--d" • / /u~c~ ~~D <br />e ' O <br />_ saNa+>.asa <br />
