,~ <br />,~ :~:~ <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 70- ~rZ(p <br /> <br />A RESOLUTION DECLARING THE NECESSITY FOR <br />THE CONTRACTING OF SIDEWALKS IN FRONT OF <br />PERMANENT PARCELS AND IN THE AMOUNT AS <br />SET FORTH IN " EXHIBIT A "ATTACHED HERETO <br />ALL LOCATED IN THE CITY OF NORTH OLMSTED <br />AND REQUESTING TH£ ABUTTING PROPERTY <br />OWNERS TO CONTRACT THE SAME, AND DE- <br />CLARING AN EMERGENCY. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That it is necessary to construct concrete sidewalks in the <br />City of North Olmsted in accordance with the plans, specifications and esti- <br />mates of cost therefore prepared by the City Engineer and now on file in the <br />office of the Clerk of Council, and in the locations as set forth in"Exhibit A ". <br />Section 2. That the: plans, specifications and estimate of cost for said <br />construction as heretofore filed be and the same are hereby approved. <br />Section 3. That the owners of all lots and lands bounding and abutting <br />upon the proposed sidewalks shall construct, in accordance with the plans and <br />specifications now on file, the portion of such sidewalks abutting on their re- <br />spective properties within a period of thirty (30) days after service of notice <br />of the passage of this Resolution, and if such construction shall not be com- <br />pleted within such period of thirty (30) days, then this Council shall have the <br />same done and the entire cost thereof shall be assessed upon the property of <br />each defaulting owner and made a lien thereon, to be collected in the manner <br />provided by law, with penalty and interest as provided by law. <br />Section 4. That the Clerk of Council is directed to cause a written notice <br />of the passage of this Resolution to be served on each affected property owner as <br />required by law. <br />Section 5 . That this Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare of the City by virtue of the need for the immediate construction <br />of such sidewalks to permit safe passage by persons using said streets and to <br />eliminate existing hazards to pedestrians..WHEREFORE, this Resolution shall <br />take effect and be in force immediately upon its passage, otherwise, at the <br />earliest period allowed by law. <br />PASSED: ~ /970 <br />ATTEST:: <br />i2.~-r_..~~ <br />Nora T.
