1 .~~~.. <br />~.,: <br />RESOr~rTxoN ~ . ,7`0 - 9~ <br />A RffiOLUTIOI~ DECTARINCr THE NECE~sITY OF CONSTRUCTII~ <br />CERTAIN STD~i~TALifS OIL BUTTES RITk~E R(?AU IE' THE CITY <br />OF 1~ORTH OIl~TED, OHIO, HE~IR]l~r THAT ABUTTI~ PRO- <br />PEEZTY OWEERS COI~TAUCT THE SAME, AND DECLARII~ AN <br />IIffiiC3C . <br />$E IT REk30LVED by the Council of the City of ATorth Olmsted, Cuyahoga <br />County, Ohio: <br />Section l: That it is necessary to construct a concrete sidewalk <br />on the south side of Butternut Ridge Road beginning at Fitch Road to a point <br />1393.11 feet east in the City of Pforth Olmsted, Ohio, in accordance with the <br />plans, specifications and estimates of cost therefor prepared by the City <br />Engineer and now on file in the office of the Clerk of Council. <br />Section 2: That the plans, specifications and esti~eate of cost for <br />said construction as heretofore filed be and the same are hereby approved. <br />Section 3: That the owners of all lots and Lands bounding and <br />abutting upon the proposed sidewalk shall construct, in accordance with the <br />plans and specifications now on file, the portion of such sidewalkz abutting <br />on their respective properties within a period of thirty days after service <br />of notice of the passage of this resolution; and, if such construction skull <br />not be cc:rnpleted within such period of thirty days, than this Council skzall <br />have the same done and the entire cost thereof shall be assessed upon the <br />property of each defaulting owner and made a lien thereon, to be collected <br />in the manner provided by law, with penalty and interest as provided by law. <br />Section 4: Tit the Clerk of this Council is directed to cause a <br />written notice of the passage of this resolution to be served on each affected <br />,property owner as required by law. <br />Section 5: That this resolution is hereby declared to be an emer- <br />gency measure necessary for the immediate preservation of the p~xblic peace, <br />health and safety by virtue of the need for the immediate construction of <br />such sidewalk to permit safe passage by persons using said streets and to <br />eliminate existing hazards to pedestrians; wherefore, this resolution shall <br />be in full force and effect from and imaaediately after its passage and ap- <br />proval by the Mayor. <br />PASSED /~,~,~~_~...Z~„1,~7d <br />U°. <br />Q~ <br /> <br /> <br /> <br />:~~w,, <br />
