", <br />~'~ <br />t , <br />OI;llINAi~C;L N0. _.rG"..._~,/ <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS <br />1~'OR THE CONSTRUCTION OF SIDEWALKS ON SOUTH <br />~RTON ROAD, AND DECLARING AN EMERGENCY. <br /> <br />BI; IT ORDAINED by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio: <br />Section l: That the assessment of the cost and expense of <br />constructing sidewalks on both sides of South Barton Road from. Lorain <br />Road southerl~,T approximately 2,716 feet in accordance Frith Resolution <br />No. 68-166, adopted October 15, 1968, amounting in the aggregate to <br />$6,627, as reported to this Council by the City En.~;ineer, notice of <br />the filing of i•~hich assessments has been given as required by J_ai•:, be <br />and the same: is hereby adopted and confirmed, and that there be; acid are <br />hereby levied and assessed upon the lots and lands boundir~~; and abu~;.tin;; <br />upon said improvement the several amounts reported as aforesaid, tlhie~: <br />assessments and the description of said lots and lands are now on ?.•i;~_~ <br />in the office of the Clerk of this Council and which assessments a.re <br />not in excess of the special benefits or in excess of any statutory limi- <br />tation; that the objection to such assessments filed by Ruth A. Charles <br />is found to be without merit and is hereby overruled; and that the ob- <br />jection of Fernand LeBlanc based on an error in the Linear feet of con- <br />crete installed on his property is well founded and the assessment of <br />his property has been reduced by $5.00 as reflected in the list of assess- <br />ments hereby adopted. <br />Section 2: That the assessment against each lot ar parcel <br />of land shall be payable in cash within thirty days after the passage <br />of this ordinance or at the option of the ownex in five annual install- <br />ments or ten semi-annual installments with intexest at the same rate as <br />shall be borne by the bonds to be issued in anticipation of the collection <br />of the same. All cash payments shall be made to the Director of Finance <br />of this City. All assessments and installments thereof remaining unpaid <br />at the expiration of said thirty days shall be certified by the Clerk of <br />this Council to the County Auditor as provided by law to be placed by him <br />on the tax duplicate and collected as other taxes are collected. <br />Section 3: That the Clerk of this Council shall certify a copy <br />of this ordinance to the County- Auditor within twenty days after its pas- <br />sage. <br />Section ~+: That this ordinance is hereby declared to be an em- <br />ergency measure necessary for the immediate preservation of the public <br />peace, health and safety of said City, and for the further reason that <br />the immediate levy of these assessments is necessary to permit bonds to <br />be issued to fund obligations of the City incurred in this improvement <br />and thereby protect the credit of the Cit?r; wherefore, this ordinance <br />shall be in full force azid e1'.['ect from c.nd imme:di~.i:eJ~~~ aa'ter its pas.;a~;e <br />and approval by the Prayor. ~ ~ <br />Passed• ~~U ~ ~" • <br />Francis J.
