This Agreement is made subject to, and conditional upon, the approval of this Agreement as to form by the Attorney General of the State of Ohio and the release of funds by the State Controlling Board and the obligations of the OWDA at any given time hereunder shall in no event exceed the amount of funds released by the Controlling Board at such time for the purposes of this Agreement. Section 6.4. The LGA shall, at the discretion of the OWDA, apply either individually or jointly with the OWDA for, and make reasonable efforts to secure, federal assistance for Federal Participation Costs pursuant to Section 8 of the Federal Water Pollution Control Act (Public Law 660, 84th Congress 1956) as amended. The LGA hereby designates the OWDA as its agent for the collection of all federal assistance pursuant to Section 8 of the Federal Water Pollution Act and authorizes payment of such federal assistance directly to, and payable to the order of, the OWDA for the payment of Federal Participation Costs or for the reimbursement of moneys advanced by the OWDA for the payment of Federal Participation Costs. The officers signing this Agreement on behalf of the LGA are authorized to advise the federal agency administering such federal assistance in writing of the foregoing designation and authorization. Section 6.5. This Agreement shall become effective as of the date first set forth hereinabove and shall continue in full force and effect until the final day of the Contract Period of Years, or until the day the obligations of the LGA under Section 4.1 hereof have been fully satisfied, whichever day is later. Section 6.6. This Agreement shall be binding upon and inure to the benefit of the parties hereto and to any person, officer, board, department, agency, municipal corporation, or body politic and corporate succeeding by operation of law to the powers and duties of either of the parties hereto. This Agreement shall not be assigned by either of the parties hereto without written consent of the other party.
