C~ ~ ,~ <br />price contract method, that adequate methods of obtaining competitive bidding will be employed <br />prior to awarding the construction contract, and that the award of the contract will be made to the <br />responsible bidder submitting the lowest acceptable bid. <br />(b) The Project Facilities will not be advertised or placed on the market I'or bidding until <br />the final plans and specifications have been approved by the Commissioner of the Federal Water <br />Pollution Control Administration, the Department of Health of the State of Ohio, and the Ohio <br />Water Development Authority and the LGA has been so notified; <br />(c) The construction contract will provide that the representatives of the Federal Water <br />Pollution Control Administration and the OWDA will have access to the work whenever it is in <br />preparation or progress and that the contractor will provide proper facilities for such access and <br />inspection; <br />(d) The construction contract will require the contractor to comply with the regulations <br />of the Secretary of Labor made pursuant to the Davis-Bacon Act of March 3, 1931, as amended (40 <br />U.S.C. 276a through 276a-5 ), the Anti-Kickback Act of June 13, 1934 (40 U.S.C. 276c), and the <br />Contract Work Hours Standards Act of August 13, 1962 (40 U.S.C. 327-330), and any amendments <br />or modifications thereto, to cause appropriate provisions to be inserted in subcontracts to insure <br />compliance therewith by all subcontractors subject thereto, and to be responsible for the <br />submission of statements required of subcontractors thereunder, except as the Secretary of Labor <br />may specifically provide for reasonable limitation, variations, tolerances, and exemptions from the <br />requirements thereto. <br />(e) A work progress schedule, utilizing the critical path method or the bar graph <br />method, shall be prepared prior to the start of construction for each construction contract to <br />indicate the proposed schedule, and it shall be maintained monthly thereafter to indicate the actual <br />progress. <br />(f) Following construction contract awards and prior to the commencement of <br />construction it will arrange and conduct a Project conference to include representatives of the <br />OWDA, the LGA and the Federal Water Pollution Control Administration and any other <br />participating federal grant agency, the consulting engineers of the LGA and the OWDA and all <br />contractors. <br />(g) All construction contracts will be so prepared that Federal Participation Costs can be <br />readily segregated from Local Participation Costs and so that materials and equipment furnished to <br />the LGA may be readily itemized. <br />(h) 1t will require the construction contractors to use U. S. Department of Labor <br />standard payroll Form No. WH 347, or a form supplying equivalent information. <br />(i) Any change or changes in a construction contract in excess of one percent (1"/0) of <br />the contract price or any change or changes regardless of cost which substantially modify the <br />treatment processes proposed will be submitted to the OWDA for prior approval. <br />(j) Notification of all change orders not requiring prior approval of the OWDA will be <br />submitted to the OWDA within one (1) month of the time at which they are ordered by the <br />consulting engineer of the LC~A. <br />(k) The construction of the Project Facilities, including the letting of contracts in <br />-5- <br />~,~ , <br />
