<br />of said property line with the Southerly right-of-way line of Lorain
<br />Road ;thence South 46° 47' 45" west a distance of 332.11 feet to
<br />the intersection point-, with the Westerly property line ;then ce
<br />South I° 42' 30" west along said westerly line a distance of 14,11
<br />feet ;thence North 46° 47' 45" east parallel to the center line of
<br />Lorain Road a distance of 342.25 feet to a point of intersection
<br />with the easterly property line of said property ;thence North
<br />43° 13' 30" west along the easterly property line a distance of
<br />10.00 feet to the point of beginning, be the same more or less,
<br />but subject to all legal highways.
<br />Dor the said purpose of constructing, maintaining, operating, repairing,
<br />altering replacing, changing the size and removing a sewer together with the
<br />necessary manholes for the transportation of sewage with the right of unim-
<br />paired access to said sewer and the right of ingress and egress, on, over and
<br />through said parcels of land for all purposes necessary and incidental to the
<br />construction , operation, maintenance, repair, altering, replacement, changing
<br />the size and removal of said sewer. There shall be reserved to the owners of
<br />the said parcels of land the right to fully use and enjoy said premises for all
<br />purposes consistent with the full use and enjoyment by the City of the easement
<br />rights herein described, but the construction of structures as defined in the
<br />Building Code of the City of North Olmsted directiy over any said sewer, except
<br />public utiiities, is prohibited, It is a further condition on the said easement
<br />rights, that the City return the surface of the ground to its original level and
<br />general condition after any of the construction, maintenance, operation, repair ,
<br />replacement, alteration, changing the size of or removal of said sewer.
<br />Section 2. That the Mayar be and he is hereby authorized and directed
<br />to cause written notice of the passage of this Resolution to be given to the owners
<br />of, or persons in possession of, or persons having an interest of record in the
<br />above described real estate, or to their authorized agents, and said notive shall
<br />be served according to law by a person tobe designated for that p~xrpose by the
<br />Mayor and to make returYx of such service in the manner provided by law.
<br />Section 3. That the Director of Law be and he is hereby authorized and
<br />directed to institute all necessary proceedings to acquire said easements, as
<br />provided for in thisResolution,
<br />Section 4, That this Resolution is hereby directed to be an emergency
<br />measure necessary for the immediate preservation of thepublic peace, safety,
<br />health and welfare of the City of North Olmsted, and for the further reason that
<br />it is necessary to have this Resolution effective immediately in order that the
<br />City may proceed with the construction of the sewer, thus contributing to the
<br />greater health and confort of the inhabitants of this City, WHEREFORE, this
<br />Resolution shall take effect and be in force immediately upon it passage, other-
<br />wise, at the earliest period allowed by law.
