PAi~G ~ , A1tD ~CIrARTRO AN <br />F~C3C. . <br />lS, this Council. on February 3, 1970, passed Ordinanoe No. 70-40 levy- <br />ing assessments in the amount of ~2,13g.06 for improving Southern Avenue by <br />paving and constructing sidewalks. and storm sewer inlets; and <br />WFiE'REA.S, the Rngineer of this City has advised this Council that the list <br />of f'~.nal. assessments heretofore approved contained certain clerical errors and <br />a corrected list of final assessments has now been filed; <br />NOWT RE, BE IT OIIDAINE© by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio: <br />Section 1. That Section 1 of Ordinance No. 70-40, passed February 3, 1870, <br />be and the same is hereby amended to read as follows: <br />"Section 1, That the revised assessment of the cost and <br />expense of improving Southern, Avenue from McKenzie Road to a <br />paint 165 feet west of Decker Avenue by ecrastructing a 7-inch <br />concrete pavement 25.5 Feet wide with appurtenances, including <br />storm sever inlets, and by constructing concrete sidewalks, <br />amounting in the aggregate to $42,816.06, as reported to this <br />Council on the 3rd day of February, 1970, and revised on A~Strch 3, <br />1970, by the Rngineer of t~,is City and now on file in the office <br />of the Clerk of Council, be and the same is hereby adapted and <br />confirmed and that there be and are hereby levied and assessed <br />upon the lots and Lands bounding and abutting upon said im- <br />provement the several amounts reported as aforesaid, which <br />assessments are in proportion to the special benefits and are <br />not in excess of any statutory limitation." <br />Section 2. That Section 1 of Ordinance No. 70-40, passed February 3, 1970, <br />as it read prior to this amendment, is hereby repealed. <br />Section 3. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its passage. <br />Section 4. This ordinance is hereby declared to be an emergency measure <br />necessary for the, immediate preservation of the public peace, health and safety <br />of said City and for the further reason that the immediate levy of such assess- <br />ments is necessary to permit the issuance of bonds to provide funds to retire <br /> <br />
