<br /> <br />BE IT ORAAINED by the Council of the City of North Olmsted, Cuyahoga County, <br />Ohio: <br />Section 1. That the revised a~ssesament of the cost and expanse of improving <br />Southern Avenue from a point 1~+4 feet west of the westerly line oP Beak,er Roe~l. <br />easterly to Buena Road, ~tecker Rcae~d frcaaa Southern Avenue to Midvale Aven~a, and <br />Midvale Avemte from Decker Read to Burns Road by grading, draining, curbing, paving, <br />constructing sidewa.'Lks, and inata7.ling sanitary sewer, stoxm saner and water curb <br />connections where necessary, amounting in the aggregate to ~81,742.~.~+, as reported <br />to this Council on the 3rd day of February, 1970, by the Engineer of this City <br />and now on file in the office of the Clerk of Council, be and the sa~sre is hereaby <br />adopted and confirmed and that there be and are hereby levied and aaa~saed u <br />the lots and lands bounding and abutting upon said improvement the aeverh7. is <br />reported as aforesaid, which assessments are in proportion to the special benefits <br />and are not in excess oY any statutory limitation. <br />Section 2. That the assessment against each lot or parcel of laud shall <br />be payable in cash within thirty days after the passage of this ordinance or at <br />the option of the owner in twenty annual or forty semi-annual inatal'Lments with <br />interest at the same rate as shall be borne by the bonds to be issued in anticipa- <br />tion of the collection of the same. All cash payments shall be made to the <br />Director of Finance of this City. A11 assessments and instal],ments thereof re- <br />maining unpaid at the expiration of said thirty days shall be cert#tLed by the <br />Clerk of Council to the County Auditor as provided by law to be placed by him on <br />the tax duplicate and collected as other taxes are collected. <br />Section 3. That the Clerk of Council shall cause a notice of the passage of <br />this ordinance to be published oaace in a newspaper of general circulation in this <br />City and to continue on file in her office said revised assessments. <br />Section ~. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its passage. <br />Section 5. This ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health and safety <br />of said City and for the further reason that the immediate levy of such assess- <br />ments is necessary to permit the issuance of bonds to provide funds to retire <br />outstanding notes and thereby protect the credit of the City; wherefore, this <br />ordinance shall be in full force and effect from and inmmediately after its passage <br />and approval by the Mayor. <br />Passed; ~ ~,~,~~ <br />Attest: <br />~~~ <br />Nora T.
