~,~ <br />~ ~' <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 73- ~.S-6 <br />BY: <br />AN ORDINANCE AUTHORIZING THE A~fAYOR TO <br />EMPLOY SPECIAL COUNSEL TO ASSIST IN THE <br />APP~PRIATION OF PROPERTY NECESSARY FOR <br />STREET PURPOSES AND TO ASSIST IN THE DEFENSE <br />OF THE CITY OF NORTH OLMSTED IN THE NEEDLE <br />CASES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted is in need of real property to extend <br />Brookpark Raad from Lorain Road to where it now terminates at Sparky Lane ;and <br />WHEREAS, said real property must be appropriated by the city ;and <br />WHEREAS, the City has been sued in the Federal District Court and the <br />Court of Common Pleas wherein the damages asked are in the total amount of <br />Two Million Dollars ;and <br />WHEREAS, Council is of the opinion that additional legal counsel is needed <br />to protect the City of North Olmsted and to secure the necess ary real estate. <br />NOW, THEREFORE, BE IT ORB~iNED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That the Mayor of the City of North Olmsted is hereby authorized <br />to employ special counsel to assist in the appropriation of property and in the <br />defense of the Needle cases against the City of North Olmsted. <br />Section 2. That this Ordinance is hereby declared to be an emergency <br />measure necesary for the preservation of the public peace, safety, health and <br />welfare of the City of North Olmstee~ by virtue of the fact that the property be <br />appropriated immediately as it is needed for the rapid and orderly growth of the <br />City of North Olmsted. WHEREFORE, this Ordinance shall take effect and be in <br />force immediately upon its passage, otherwise, at the earliest date permitted <br />by law. <br />PASSE ~f~ <br />ATTEST: <br />~~ ~~~ <br />Nora T.
