y <br />w <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 73-/3~ <br />BY: , <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF <br />PUBLIC SAFETY TO OBTAIN COST FIGURES FOR THE <br />REPLACING OF THE ENGINE IN NUMBER 4 , SEAGRAVE <br />PUMPER FIRE TRUCK, AUTHORIZING TH$ MAYOR TO <br />EXECUTE A CONTRACT FOR SAME, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the Safety Director has advised the Public Safety, Health <br />and Welfare Committee of Council that Fire Engine Number 4 is inoperable <br />due to the need of a new motor ; and <br />WHEREAS, the Safety Committee of Council and the Finance Committee <br />of Council ha~r+e. decided that a real and present emergency exists due to the <br />need of Fire Engine Number 4 by the Fire Department of the City of North Olmsted, <br />and that appropriate funds are available to repair said fire engine ;and <br />WHEREAS, Ohio Revised Code 735.051 provides that a municipality may <br />obviate the regulation requiring formal bidding when a real and present emergency <br />exists , such as in this instance ,and Council of the City of North Olmsted recog- <br />nizing the dire need to have Fire Engine Number 4 in immediate operation for the <br />pr®tection of the residents of North Olmsted now wishes to have Fire Engine <br />Number 4 repaired at the earliest possible date. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That the Director of Public Safety is authorized to secure repairs <br />and/or replacement charges for the motor in Fire Engine Number 4, Seagrave Pumper <br />Fire Truck immediately without securing formal bids and that upon securing same <br />and being satisfied that cost estimates are equitable, reasonable and fair the <br />Mayor of the City of North Olmsted is hereby authorized to enter into a contract <br />for the immediate repair and/or replacement of the motor in Fire Engine Number <br />4, Seagrave Pumper Fire Truck of the North Olmsted Fire Department. <br />Section 2. That this Resolution is declared to be an emergency measure <br />necessary for the preser~ration of the public peace, safety, health and welfare <br />of the City of North Olmsted by virtue of the fact that the need of Fire Engine <br />Number 4 is for the health, safety and welfare of the citizens of North Olmsted. <br />WHEREFORE, this Resolution, providing it receives a favorable vote by two-thirds <br />( 2/3) of the members of Council shall go into effect immediately upon the signature <br />of the Mayor<~sf the City of North Olmsted ,otherwise, i.t shall take effect at the <br />earliest date permittedy by law. <br />PASSED: /"~+s dwc.~.•~m. /~~ <br />ATTEST: Q~ <br />Nora T.
