<br />ar: ~:,~ . <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 73- ,~(,~~ <br /> <br />A RESOLUTION- AUTHORI7ING THE MAYOR TO <br />JOIN THE CITY OF NORTH OLMSTED WTTH OTHER <br />MUNICIPALITIES IN CERTAIN LITIGATION PENI~NG <br />IN THE UNITED STATES DISTRICT NORTHERN <br />DISTRICT OF OHIO, EASTERN DIVISION, INVOLVING <br />THE RIGHT OF A MUNICIPALITY TO DETERMINE THE <br />NEED FOR SUBSII~Z£D'LOW-RENT PUBLIC HOUSING, <br />AND AUTHORI~tNG THE OOA COUNTY MAYORS <br />AND G"iTY MANAGERS A sSOCiATION TO COORIIINA:TE <br />FUNDS THEREFOR, AND DECLARING AN EMERGENCY. <br />WHEREAS, there is pending in the United States District Court, Northern <br />District of ONi~, Eastern Division, the case of Mahaley, et al. vs. Cuyahoga <br />Metropolitan Housing Authority, et al. , Civil Action C 71-251, in which it appears <br />that the Federal Court may negate the provisions of the Federal Housing Law which <br />require a cooperation agreement as a condition precedent to the establishment of <br />subsidized low-rent public housing in this City of North Olm~ed ;and <br />WHEREAS, the Council of the City of North Olmsted believes that such a <br />ruling by a Federal Court would be an invasion of its constitutional home-rule power <br />to determine the needs of ttlffilty of North Olmsted and for the proper implementation <br />thereof ;and <br />WHEREAS, the aforesaid lawsuit is regarded by this Council as of sufficient <br />public interAst to justify the City of North Olmsted joining with other municipalities <br />in the cost cf the defense thereof. <br />NOW, THEREFORE , BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That the City of North Olmsted shall join with all other affected <br />municipalities enacting similar legislation in all proper legal action to defend the <br />aforesaid litigation. <br />Section 2. That the Cuyahoga County Mayors and City ManagerAssocation <br />is authorized to coordinate the funds contributed for the defense of said litigation as <br />provided herein. <br />Section 3. That. the amount of bescontributed by the City of North Olmsted <br />shall be $. 06 per capita based on the 1970 census or a total sum of $2, 0$8.00, which <br />sum i s hereby appropriated and shall be paid to the Cuyahoga County Mayors and <br />City Managers Association for the purpose of paying the City of North Olmsted's <br />proportf-ovate share of the cost of defending such litigation. <br />Section 4. That the Clerk of Council be and she is hereby authorized and <br />directed to forward a certify copy of this Resolution to the Executive Secretary of the <br />Cuyahoga County Mayors and City Managers Association . <br />,_ <br />_ _ - , <br />j <br />
