ACKROYD , AUTHORIZING A <br />REFUND TO F.L. & E. ACKROYD IN THE AMOUNT OF <br />$102.44, WHICH $102.44 WAS PAID IN ERROR BY <br />F.L. & E ACKROYD, LEVING A SAP~ITARY SEWER <br />ASSESSMENT ON PERMANENT PARCEL NO. 231-32- <br />34 FOR THE TAX 1972 to 1991 IN THE AMOUNT OF <br />$102.44 PER YEAR. <br />WHEREAS, F.L. & E. Ackroyd received an assessment on Permanent Parcel <br />No. 231-32-7 for sanitary sewers on Columbia Road ;and <br />WHEREAS, F. L. & E. Ackroyd owners of Permanent Parcel No. 231-32-7 <br />do not have property fronting on Columbia Road, as Permanent Parcel No. 231-32-7 <br />is back land property and, therefore, does not benefit from the sanitary sewer at <br />the present time ;and <br />WHEREAS, F.L. & E. Ackroyd paid a sanitary sewer assessment in error <br />in the amount of $102.44 and now wishes to be reimbursed for the sufn of money, <br />$102.44, incorrectly paid ;and <br />WHEREAS, Permanent Parcel No. 231-32-34 owned by Joseph C. &Adaline <br />Baker does front on Columbia Road and, therefore, does benefit from the sanitary <br />sewer ; and <br />WHEREAS, the predecessor in title of Permanent Parcel No. 231-32-34, <br />presently owned by Joseph C. &Adaline Baker were notified of the sanitary sewer <br />assessment on or about February 2,1972 and th&n sold std Permanent Parcel No. <br />231-32-34 to Joseph C. & AdalineBaker ; and <br />WHEREAS, the sanitary sewer for the years 1972 to 1991 was assessed against <br />the wrong Permanent Parcel Number, namely Permanent Parcel No. 231-32-7 instead <br />of Permanent Parcel No. 231-32-34 ;and <br />WHEREAS, Council now wishes to correct the incorrect assessment by re- <br />moving the assessment on Permanent Parcel No. 231-32-7 and authorize the return <br />of the one installment in the amount of $102.44 and further wishes to place the <br />assessment on Permanent Parc~:l No. 231-32-34 owned by Joseph C. &Adaline <br />Baker, formerly owned by F.L. & E. Ackroyd. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That the sanitary sewer assessment in the amount of $102.44 per <br />year for the years 197 to 1991 on Permanent Parcel No. 231-32-7, awned by F.L. <br />& E. Ackroyd ~, is hereby removed, and the Director of Finance is authorized to return <br />the sum paid by F.L. & E. Ackroyd in the amount of $102.44 to F.L. & E.
