,: <br />CITY OF 140RTH OLM.STID <br />ORDINANCE NO. <br />BY: <br />AN 0 INAI4CE LEVYING SPECIAL ASSESSMEpTS FOR THE <br />COIiSTRT1CTION OF SIDEWALKS ON COLtI~lBIA ROAD, MAPLE <br />RIDGE ROAD, EAST PARR DRIVE AND TERRACE DRIVE,AI4D <br />DECLARII'~ AN EMET~GEfiiCY. <br />BE IT ORDAIl~ED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio: <br />Section l: That the assessment of the cost and expense of construct- <br />ing sidewalks on the south side of l~tple Ridge Road from Columbia Road to <br />Walter Road, west side of Columbia Road from Lorain Road to Lessner Road, <br />Est side of East Park Drive from Lorain Road to North Park Drive, north <br />side of Terrace Drive in front of the properties identified on the Cuyahoga <br />Csunty Auditor's tax maps as Permanent Parcel 140. 235-10-31 and Permanent <br />Parcel 140. 235-10-32, as set forth in Resolution No. 71-95, adopted June 15, <br />1971, where such sidewalks were not constricted by the abutting property <br />owners pirsuant to the option offered by said resolution, amounting in the <br />aggregate to ~2,7b$.95, as heretofore reported to this Council by the City <br />Engineer, notice of the filing of which assessments has been given as re- <br />quired by law, be and the same is hereby adopted and confirmed, and that <br />there be and are hereby levied and assessed upon the lots sad lands bound- <br />ing. and abutting upon said impmvement the several amounts reported as <br />aforesaid, which assessments and the description of said lots and lands are <br />now on file in the office of the Clerk of this Council and which assessments <br />are not in excess of the special benefits or in excess of any statutory <br />limitation. <br />Section 2; That the assessment against each lot or parcel of land <br />shall be payable in cash within thirty days after the passage of this ordi- <br />nance or, at the option of the owners, in five anrma:l. or ten semi-annutl. <br />installments with interest at the same rate as shall be borne by the bonds <br />to be issued in anticipation of the collection of the sane. All cash pay <br />ments shall be made to the Director of Finance of this City. All~asseas- <br />ments and installme~ats thereof remaining unpaid at the expiration of said <br />thirty days shall be certified by the Clerk of this Council t0 the County <br />Auditor as provided by lax to be placed by him on the tax duplicate and col- <br />lected as other taxes are collected. <br />Section 3: That the Clerk of this Council shall certify a cogy of <br />this ordinance to the County Auditor within twenty days after its passage. <br />Section 4: This ordinance is hereby declared to be an emergency mea- <br />sure necessary for the immediate preservation of the public pewaee, health <br />and safety of said City, and for the firther reason that the immediate levy <br />of these assessments is necessary to permit bonds to be issued to retire <br />outstanding notes issued in anticipation of such bonds and thereby protect <br />the credit of the City; ~erefore, this ordinance shall be in full force <br />and effect from and immediately after its passage and approval by the Ma~ror. <br />Passed: , l9'7~ <br />Attest: ~ ~ •~ <br />Nora T. x.13., o ouncil <br />Approved: -=~i-{~ 7.~ ~~, 1973 <br />~- <br />Francis J. 0 Re en o +vinci]. <br />• <br />E. r , "or <br />
