,.- - ~ <br />l~ <br />G <br /><„~ - <br />A G R E E M E N T <br />THIS AGREEP'~NT, made and entered into the 12th _ day of November , <br />1973, by and between the City of Ilorth Olmsted, Ohio hereinafter referred <br />to as City, and the North Olmsted Board of Education hereinafter referred to <br />as Board. <br />[dHEREAS, the City and the Board have entered into Agreements on the <br />I2th day of April, 1965 and the 20th day of September, 1966; and <br />WHEREAS, both agreements provided for joint playground and recreation <br />areas, their development, operation and maintenance; and <br />WHEREAS, both agreements provided that said development, equipment and <br />maintenance to be in accordance with recommendations made by committees de- <br />signated in the agreements; and <br />WHEREAS, by Charter of the City a Parks and Recreation Commission has <br />been established with representatives appointed by the City and the Board; <br />and <br />WHEREAS, the City now desires to make a commitment of $125,000.00 to <br />develop parks and recreation areas throughout the City and to apply to the <br />Federal Government for matching funds equal to this commitment; and <br />WHEREAS, the agreement of April 12, 1965 provided for the establishment <br />of a playground and recreation area set forth therein at Pages 6 and 7 and <br />that the Board expend a minimum of $15,000.00 in developing and equipping the <br />said playground and recreation area, and by informal agreement of the parties <br />the said Board has expended $10,000.00 of this consideration in other areas; <br />and <br />WHEREAS, Section Two of said agreement of September 20, 1966 provided <br />as follows: <br />"That upon determination by the Council of the City that land is to <br />be used for playground and recreation purposes and further when <br />said land is adjacent to a school site and the Board agrees that <br />said land is suitable for playground and recreation purposes, the <br /> <br />
