C CITY OF NORTH OLMSTED ORDINANCE NO. 73- BY: G%~ AN ORDINANCE CANCELLING THE SANITARY SEWER ASSESSMENT ON PERMANENT PARCEL NO. 232-34-020 OWNED BY MR. & MRS. LINGELBACH, AUTHC7RIZING P, REFUND TO MR. & MRS. LINGELBACH IN THE A- MOUNT OF $102.44, WHICH $102.44 WAS PAID IN ERROR BY MR. & MRS. LINGELBACH, LEVYING A SANITARY SEWER ASSESSMENT ON PERMANENT PARCEL NO. 232-34-104 FOR THE TAX YEARS 1972 to 1991 IN THE AMOUNT OF $102.44 PER YEAR. WHEREAS, Mr. & Mrs. Lingelbach received an assessment on Permanent Parcel No. 232-34-020 for sanitary sewers on Root Road ;and WHEREAS, Mr. & Mrs. Lingelbach owners of Permanent Parcel No. 232-34-020 do not have property fronting on Root Road, as Permanent Parcel No. 232-34-020 is back land property and, therefore, does not benefit from the sanitary sewer at the present time ;and WHEREAS, Mr. & Mrs. Lingelbach paid a sanitary sewer assessment in error in the amount of $102.44 and now wishes to be reimbursed for the sum of money, $102.44, incorrectly paid ;and WHEREAS, Permanent Parcel No. 232-34-104 owned by Bruce A. and C. D. Bruehler does front on Root Road and, therefore, does benefit from the sanitary sewer ; and WHEREAS, the predecessor in title of Permanent Parcel No. 232-34-104, presently owned by truce A, and C. D. Bruehler, James L. and M. E. Muller were notified of the sanitary sewer assessment on or about February I, 1972 and then sold said Permanent Parcel No. 232-34-104 to Bruce A. and C. D. Bruehier ; and WHEREAS, the sanitary sewer for the years 1971 to 1991 was assessed against the wrong Permanent Parcel Number, namely Permanent Parcel No. 232-~4-020 in- stead of Permanent Parcel No. 232-34-104 ;and WHEREAS, Council now wishes to correct the incorrect assessment by re- moving the assessment on Permanent Parcel No. 232-34-020 and authorize the re- t~n) of the one installment in the amount of $102.44 and further wishes to place the assessment on Permanent Parcel No. 232-34-104 owned by Bruce A. and C. D. Bruehler, formerly owned by James L. and M. E. Mullen. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio Section 1. That the sanitary sewer assessment in the amount of $102.44 per year for the years 1972 to 1991 on Permanent Parcel No. 232-34-420, owned by Mr. & Mrs. Lingelbach, is hereby removed, and the Director of Finance is authorized to return the sum paid by Mr. & Mrs. Lingelbach in the amount of $102.44 to Mr. & Mrs. Lingelbach.
