CITY OF NORTH OLMSTED /} ORDINANCE NO. 73-5 AN ORDINANCE VACATING PORTIONS OF ZEHMAN STREET, ACCEPTING FOR DEDICATION THE RE- LOCATION OF SAME, AND GHANGING THE NAME OF ZEHMAN STREET TO WEST 308 STREET. WHEREAS, all the property surrounding the street now known as Zehman Street is owned by the West Side Land Company ;and WHEREAS, the West Side Land Company has petitioned this Council to vacate a portion of Zehman Street, now dedicated, and to relocate same and have so requested the vacation of Zehman Street in conformity to Ohfo Revised Code 723.04 ;and WHEREAS, the owners of all land surrounding Zehman Street have further consented to the vacation of said street in conformance with Ohio Revised Code 723.06 thereby negating the necessity of the requirements of Ohio Revised Code 723.07, which section requires the publishing of the Notice to Vacate for six (6 ) consecutive weeks, and the Council having been duly informed of the rea ons for the vacating bf said Zehman Street and further the changing of the name to West 308 Street, now wishes to do so ;and WHEREAS, Council being satisfied, as to the need of relocating of said street and further that all legal requirements have been met, does hereby. consent to the vacating of Zehman Street, as now duly dedicated, accepts for dad#cation the new section of said street for dedication, and further changes the name of the relocated Zehman Street to West 308 Street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That the street formerly known as Zehman Street is vacated as to the metes and bounds description as set forth in " Exhibit B "attached herewith and made a permanent part of this Ordinance, as if fully rewritten herein, and further set forth on the plat map also attached herewith and marked " Exhf~it A ". Section 2. That the Council of the City of North Olmsted hereby accepts for dedication Zehman Street as relocated together with the name change to West 308 Street, as set forth in " Exhibit A " attached hereto, and further described by metes and bounds in " Exhibit C "attached hereto. Section 3. That all portions of Zehman Street heretofore referred to as Zehman Street are now changed and are to be known as West 308 Street. Section 4. That the Engineer of the City of North Olmsted is hereby instructed to inform the Cuyahoga County Recorder and the Cuyatuags County Auditor, both as to the vacation of the street formerly known as Zehman Street ; the relocation of West 308 Street (formerly known as Zehman Street) and the change of name, and further the Engineer of the City of North Olmsted is to ad- vise the Water Department of the City of `iGleveland, both as to the relocation of the aforementioned street and as to the change of mane of the aforementioned street. ~,_,.
