CITY OF IJORTH OLMSTED ORDINAN CE NO. 68- ZO3 BY AN ORDINANCE VACATING LAMONT DRIVE AND THE SOUTHERLY PORTION OF WESTVIEW DRIVE IN THE CITY OF NORTH OLMSTED, AN D DECLARING AN EMERGEN CY. WHEREAS, the land surrounding Lamont Drive and the southerly portion of Westview Drive is owned by one owner who has requested the vacation of Lamont Drive and the southerly portion of Westview Drive, both situated in the City of North Olmsted ; and WHEREAS), Council having been advised by the Design and Platting Committee of Council, and the Municipal Development Committee of Council that the vacation of Lamont Drive and the southerly portion of Westview Drive wQiabdbest serve the City of North Olmsted and its residents ; and WHEREAS, Counail has been advised by the Law Department of the City of North Olmsted that a law suit has been filed in Cuyahoga County'_: Common Pleas Court requesting the vacation of Lamont Drive and the 6outherly portion of Westview Drive. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of 1VqfiAh Olmsted, State of Ohio: Section 1. That the vacation of Lamont Drive and the southerly portion of Westview Drive izlmscribed as follows: Situated in the City of North Olmsted, County of Cuyahoga and State of Ohio and being part of Original Dover Township Lot No. 8 and being further known as part of Westview Drive ( 60 feet Wide ) as shown on the plat of Columbia Land Developeaerrt Co. Subd. No. 3 as revorded in Volume 184, Page 70 of Cuyahoga County Map Re- cords and being bounded and described as follows: Beginning at the intersection of the Easterly line of Westview Drive withthe Northerly line of Sublot No. 68 ; thence, south 0° 45' 12" west 115.95 feet to a point of curvature ; thence, 45.23 feet along the arc of a circle deflecting to the left,chord of 40.56 feet bearing south 45 ° 5' 4" east to a point to tangency; thence, south 89 ° 4' 40" west 120.00 feet ; thence, northessterly 48.99 feet along the arc of,?a circle deflecting to the left having a chord of 44. 28 feet bearing north 44° 54' 56" east to a point of curvature; thence, north 0° 45' 12" lbast 114.19 feet ; thence, north 89° 4' 40" east 60.02 feet to the place of beginning. being the dame is hereby vacated. Section 2. That the Clerk of Council is hereby directed to notify the Auditor of Cuyahoga County of the above vacation of Lamont Drive and the southerly portion of Westview Drive situated in the City of North Olmsted by sending him a certified and conformed copy of this ordinance.
