CITY OF NORTH OLMSTED <br />ORDINANCE NO. 68--A,,0,0 <br />$Y ' p?„ Jf iw .1 <br />AN ORDINANCE ENACTIIVG CHAPTER 1331 OF TITLE <br />SEVEN OF THE CODIFIED ORDINANCES OF THE CITY <br />OF NORTH OLMSTED BY ESTABLISHING THE <br />PROCEDURE AND STANDARDS FOR THE INSPECTION, <br />REPAIR, VACATION, AND DEMOLITION OF DANGEROUS <br />OR UNSAFE BUILDINGS; PROVIDING FOR THE APPEALS <br />FROM THE ORDERS OF THE BUILDING COMMISSIOIVER <br />BY ESTABLISHING A BOARD OF APPEALS; REPEALING <br />SECTIONS 1331.01 to 1331.06, INCLUSIVE, OF <br />CHAPTER 1331 TITLE SEVEN OF THE CODIFIED <br />ORII[NANCES OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERG£NCY <br />WtIEREAS, Council has been advised that there are dangerous and <br />unsafe buildings within the City of North Olmsted; and <br />WHEREAS, Council wishes to establish a set of standards to be used by <br />the Building Commissioner, Police Department and Fire Department in determining <br />that a building is dangerous and/or unsafe; and <br />WIiEREAS, Council wishes to provide the property owner a procedure to <br />appeal the orders of the Building Commissioner. <br />NOW, THEREFORE, BE IT ORDAIIVED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section l: That Title Seven, Chapter 1331 is hereby implimented by <br />enacting the following sections: <br />1331.01 DANGEROUS BUILDING DEFINED. <br />All buildings or structures which have any or all of the following defects <br />shall be deemed "dangerous buildings": <br />(a) Those whose interior walls or other vertical structural <br />members list, lean or buckle to such an extent that a plumb <br />line passing through the center of gravity falls outside of <br />the middle third of its base. <br />(b) Those which, exclusive of the foundation, show thirty-three <br />percent or more of damage or deterioration of the supportin§ <br />membe-r, or,_ members, or fifty percent of damage or deterioration <br />of the nonsupporting enclosing or outside walls or covering. <br />(c) Those which have improperly distributed loads upon the floors <br />or roofs or in which the same are overloaded, or which have <br />insufficient strength to be reasonably safe for the purpose used. <br />(d) Those which have been damaged by fire, wind or other causes <br />so as to have become dangerous to life, safety, morals or the <br />general health and welfare of the occupants or the people of <br />the City. <br />(e) Those which have become or are so dilapidated, decayed, unsafe, <br />insanitary or which so utterly fail to provide the amenities <br />essential to decent living that they are unfit for human <br />habitation, or are likely to cause sickness or disease, so as <br />to work injury to the hea lth, morals, safety or general welfare <br />of those living therein.
