CITY OF NORTH OLMSTED <br />ORDINANCE NO. 68- Jq6 <br />BY ? • ?i,g,?rt? <br />AN ORDINANCE ENACTING SECTION 533.07 ENTITLED <br />" INHALING TOXIC VAPORS, " AND SECTION 533.08 <br />ENTITLED " INDUCING PERSONS TO INHALE TOXIC <br />VAPORS, " OF CHAPTER 533 ENTITLED " OFFENSES RE- <br />LATING TO PERSONS, " OF PAR.T 5 OF THE CODIF IED <br />ORDINARCES OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohfo : <br />Section 1. That Section 5 33 . 0 7, Chapter 533, Part 5 of the Codified <br />Ordinances be and the same is hereby enacted to read as follows: <br />Section 533.07 Inhalincr Toxic Vapors <br />( a) It is unlawful for any person deliberately to smell or inhale <br />any drug, or any other noxious substances or chemicals containing <br />any ketones, aldehydes, organic acetates,ether, chlorinated hydro- <br />carbons, or any other substances containing solvents releasing toxic <br />vapors in such excessive quantities as cause conditions of intoxication, <br />inebriation, excitement, stupefaction or dulling of the brain or nervous <br />system. This section applies with particularity to but not limited to <br />finger nail polish, model airplane glue, or any other substance or chemi- <br />cal which has the aforementioned effect upon the brain or nervous <br />system when smelled or inhaled. <br />( b) Notwithstanding the general penalty provided in this Chapter, <br />any person violating this section shall be guilty of a misdemeanor <br />and upon conviction thereof, shall be fined not le5s than $25.00 nor . <br />more than $100. 00 for the first offense, and not less than $50.00 nor <br />more than $200.00 and be imprisoned not more than six ( 6) months <br />or both for each subsequent offense. <br />Section 2. That Section 533.08, Chapter 533, Part 5 of the Codified <br />Ordinances be and the same is hereby enacted to read as follows: <br />Section 533.08 Inducincr Persons to Inhale Toxic Vapors <br />( a) It shall be unlawful for any unauthorized or unlicensed person <br />to cause, invite or induce any person to smell or inhale any drugs, <br />or any other noxious substances or chemicals containing ketone, alde- <br />hydes, organic acetates, ether , chlorinated hydrocarbons, crr any <br />other substances containing solvents releasing toxic vapors, which <br />when inhaled or smelled in excessive quantities cause conditions of <br />intoxication, inebriation, excitement, stupefaction or dulling of the <br />brain or neverous system.
