ORDINANCE N0. <br />AN ORDINANCE DETERMIDTING TO PROCEED WITH THE CON- <br />STRUCTION OF A CONCRETE SIDEWALK ON THE EASTERLY <br />SIDE OF DOVER CENTER ROAD BErl'WEEN LORAIN ROAD AND <br />BUTTERNUT RIDGE ROAD IN THE CITY OF NORTH OI,MSTED, <br />OHIO, AND DECLARING AN EMERGENCY. <br />Ohio: <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, <br />Section l. That it is hereby determined to proceed with the improvement of <br />Dover Center Road in the City of North Olmsted by constructing a concrete sidewalk <br />on the easterly side of said street between Lorain Roa,d and Butternut Ridge Road. <br />Section 2. That said improvement shall be made in accordance with the pro- <br />visions of Resolution No. 68-14+ passed on September 3, 1968, a.nd with the plans, <br />specifications, estimates and profiles heretofore approved and now on file in <br />the office of the Clerk of this Council. <br />Section 3. That all clai.ms for damages resulting therefrom tha.t have been <br />legally filed sha.ll be inquired into before the cammencement of the proposed <br />improvement, and the Director of Law is hereby authorized and directed to in- <br />stitute legal proceedings in a court of c anpetent jurisdiction to inquire into <br />claims that have been so filed. <br />Section 4. Tha,t the portion of the cost provided in the above mentioned <br />resolution of necessity to be assessed shall be assessed in the manner and the <br />number of installments provided in said resolution and on the lots and la.nds <br />described therein. <br />Section 5. That the estimated assessments for such improvement heretofore <br />prepared by the City Engineer and filed in the office of the Clerk of Council <br />and eonfirmed by the Assessment.Equalization Board, the report of which Board <br />was approved by Resolution No. 6J-;-, adopted November 6, 1968, be and the <br />satne are hereby adapted. <br />Section 6. The Clerk of Council is hereby directed to deliver a eertified <br />copy of this ordinance to the County Auditor with3n fifteen days after its passage. <br />Section 7. Subject to the provisions of Section 727.21+, Revised Cod.e, the <br />Mayor of the City is hereby authorized and directed as soon as the funds therefor <br />are available to make and execute a contract for said i.mprovement with the lowest <br />and best bidder after advertising according to 1.aw and the improvement shall be <br />financed as provided in the resolution of necessity. <br />Section 8. This ordinance is hereby declared to be an emergency measure <br />necessary for the immed3ate preservation of the public peace, health and safety <br />of said City, and for the further reason that the immediate construction of such <br />sidewalks is necessary to permit safe passage by persons using said streets a.nd to <br />eliminate existing hazards to pedestrians; wherefore, this ordinance shall be in <br />full force a.nd effect from a.nd immediately after its passage and approva.l by the <br />Mayor. <br />Passed; <br />Attest c,¢J CA1 <br />Florence Ho , Clerk of Council <br />Approved: // I6AQ <br />lph E.
