BY GRADINGi DRAINING., C[TRBING, PAVING? CONSTRUCTIlVG SIDEWALKS? AND INSTALLING SAlVITARY SEWER., STORM SEWER APID WATER CURB CONNECTIONS WHERE NECESSARY? AND DECLARING AN EMERCENCY. WHEF2EAS., the Assessmnt Equalization Board heretofore appointed by Resolution No. 68 -11+3 of this Council passed September 3, 1968, to hear and determire al1 objections concerning the estimated assessments for the improvt- ment of 5outhern Avenue from a point 140 feet west of the westerly lim of Decker Road easterly to Burns Road, Decker Road from Southern Avenue to Midvale Avenue, and Midvale Avenue from Decker Road to Burns Road by grading, draining, curbing, paving, constructixig sidewalks, and installing sanitary sewer, storm sewer and water curb corunections where necessary in accordance with Resolution No. 68-137 of this Council passed August 13, 1968, has filed its report with this Council as to its determination of such objections; and WHEREAS, Council deems such report proper in all respects; NOW., THEREFORE., BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga County, Ohio: Section 1. The report of the Assessment Equalization Board herein- before recited be and the same is hereby approved and the assessments as equalized by said Board and reported by it be and they are hereby directed to be filed in the office of the Clerk of Council. Section 2. That the amount by which the original estimated assess- ments were reduced by the Assessmnt Equalization Boaxd shall be assumed by tYe City in addition to the portion of the cost of the improvement which the City is required to beax under Resolution No. 68-137. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health arxl safety of said City, and for the further reason that the immediate construction of said improvement is necessary to elimi.nate existing hazards to pedestrian and vehicular traffic; wherefore, this resolution shall be in full force and effect from and innediately after its passage and approval.
