CITY OF NORTH OLMSTED Resolution No. 68-110 Page 2 Parcel C- Marguerite H. Cecil, widow and not remarried - Permanent Parcel No. 232-31-3 The easement is further described as being over and through a parcel of land ten (10) feet in width, the centerline of which begins at a point on the south line of the above des- dribed permanent parcel, this point being west a distance of 914 feet from the centerline of Root Road; thence in a northerly direction for a distance of 158.5 feet to a point on the north line of said permanent parcel, this point being west a distance of 906 feet from the centerline of Root Road as shown on the attached drawing No. N-21. A temporary easement over two parcels of land, each twenty (20) feet in width and 158.5 feet in length located on the east and west sides of the above described permanent ease- ment is hereby granted for the period of time required to construct the sewer through this property. for the purpose of constructing, maintaining, operating, repairing, altering, replacing, changingthe size and removing a sewer together with the necessary manholes for the transportation of sewage with the right of unimpaired access to said sewer and the right of ingress and egress on, over and through said parcels of land for all purposes necessary and incidental to the construction, operation, maintenance, repair, altering, replacement, changing the size and removal of said sewer. There shall be reserved to the owners of the said parcels of land the right to fully use and enjoy said premises for all purposes consistent with the full use and enjoyment by the City of the easement rights herein described, but the construction of structures as defined in the Building Code of the City of North Olmsted directly over any said sewer, except public utilities, is prohibited. It is a further condition on the said easement rights that the City return the surface of the ground to its original level and general condition after any construction, maintenance, operation, repair, replacement, alteration, changing the size of or removal of said sewer. Section 2: That the Mayor be and he is hereby authorized and directed to cause written notice of the passage of this Resolution . to be given to the owners of or persons in possession of or persons having an interest of record in the above described real estate or to their authorized agents and said notice shall be served according to law by a person to be designated for that purpose by the Mayor and to make return of such service in the manner provided by law. Section 3: This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health and safety of this City and for the further reason that it is necessary to have this Resolution effective immediately in order that the City proceed with the construction of the sewer presently in procees thus contributing to the greater health and comfort of the inhabitants of this City. WHEREFORE, this Resolution shall take effect and be in force immediately upon its passage, otherwise, at the earliest period allowed by law. PASSED: ?e r ATTEST:u ? ?
