CITY OF NORTH OLMSTED <br />ORDINANCE N0. 6b "' iL <br />By <br />AN ORDINANCE I,EVYING SPECIAI, ASSESSMENTS FOR <br />THE CONSTRUCTION OF SIDEWALKS ON DOVER CENTER <br />ROAD AND KENNEDY RIDGE ROAD, AND DECLARTNG AN <br />EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuya- <br />hoga County, Ohio: <br />Section 1: That the assessment of the cost and expense of con- <br />structing sidewalks on the west side of Dover Center Road frorn Lorain Road <br />northerly to the corporation line, on the north side of Kennedy Ridge Road <br />from Great 1Vorthern Boulevard easterly approximately 1920 feet to the east- <br />erly line of Permananet Parcel No. 236-10-22, and on the north side of <br />Kennedy Ridge Road from the westerly line of Permanent Parcel No. 236-13-6 <br />easterly approximately 1820 feet to Columbia Road in accordance with Reso1- <br />ution No. 66-150, amounting in the aggregate to $19,446.71, as reported to <br />this Council on the 25th day of January, 1968 by the City Engineer, notice <br />of the filing of which assessments has been given as required by law, be <br />and the same is hereby adopted and confirmed, and that there be and are <br />hereby levied and assessed upon the lots and lands bounding and abutting <br />upon said improvement the several amounts reported as aforesaid, which <br />assessments and the description of said lots and lands are now on file in <br />the office of the Clerk of this Council and which assessments are not in <br />excess of the special benefits or in excess of any statutory limitation; <br />that the objection to such assessments filed by John L. Minotti is found <br />to be without merit and is hereby overruled; and that the objection of Ed- <br />ward M. Young based on an error in the assessable frontage of his property <br />is well founded and the assessment on his property has been reduced by <br />$17.33 as reflected in the list of assessments hereby adopted. <br />Section 2: That the assessment against each lot or parcel of land <br />shall be payable in cash within thirty days after the passage of this ordi- <br />nance or at the option of the owner in five annual installments with interest <br />at the same rate as shall be borne by the bonds to be issued in anticipation <br />of the collection of the same. All cash payments shall be made to the <br />Director of Finance of this City. Al1 assessments and installments thereof <br />remaining unpaid at the expiration of said thirty days shall be certified by <br />the Clerk of this Council to the County Auditor as provided by law to be <br />placed by him on the tax duplicate and collected as other taxes are collected. <br />Section 3: That the Clerk of this Council shall certify a copy of <br />this ordinance to the County Auditor within twenty d.ays after its passage. <br />Section 4: This ordinance is hereby declared to be asn emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety of said City, and for the further reason that the irrunediate levy <br />of these assessments is necessary to permit bonds to be issued to fund the <br />outstanding note issued in anticipation of the bonds and thereby protect the <br />credit of the City; wherefore, this ordinance shall be in full force and <br />effect from and immediately after its passage and approval by the Mayor. <br />PASSED: <br />ATTEST: <br />Clerk of Council <br />APPROVED : <br />? <br />? • <br />Mayor <br />? <br />President f Juncil <br />a <br />^-? <br />(J
