ORDINANCE N0._4 <br />AN ORDINANCE I,EVYING SPECIAL ASSESSMEN'I'S FOR THE IMPROVE- <br />MENT OF SOUTHERN AVENUE IN THE CITY OF NORTH OLMSTED,OHIO, <br />BETWEEN CERTAIN TERMINT BY INSTALLING A STORM SEWER AND <br />NECESSARY APPURTENANCES, AND DECLARING AN EMERGENCY <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuya- <br />hoga County, Ohio: <br />Section l. That the revised assessment of the cost and expense <br />of improving Southern Avenue from the existing ditch east of Burns Road <br />westerly to a point approximately 120 feet east of McKenzie Road, by in- <br />stalling a storm sewer and necessary appurtenances, amounting in the aggre- <br />gate to $ 20 as reported to this Council on the lst day of October, <br />1968, by he Engineer of this City and now on file in the office of the <br />Clerk of Council, be and the same is hereby adopted and confirmed and that <br />there be and are hereby levied and assessed upon the lots and lands bound- <br />ing and abutting upon said improvement the several amounts reported as <br />aforesaid, which assessments are in proportion to the special benefits and <br />are not in excess of any statutory limitation. <br />Section 2. That this Council hereby finds and determines that the <br />revised assessments as now on file in the office of said Clerk are in the <br />same proportion to the estimated assessments as originally filed as the <br />actual cost of the above described i.mprovement is to the estimated cost of <br />the improvement as originally filed. <br />Section 3. That the assessment against each lot or parcel of <br />land shall be payable in cash within thirty days after the passage of this <br />ordinance or at the option of the owner in ten annual installments with <br />interest at the same rate as shall be borne by the bonds to be issued in <br />anticipation of the collection of the same. All cash payments shall be <br />made to the Director of Finance of this City. All assessments and install- <br />ments thereof remaining unpaid at the expiration of said thirty days shall <br />be certified by the Clerk of Council to the County Auditor as provided by <br />law to be placed by him on the tax duplicate and collected as other taxes <br />are collected. <br />Section 4. That the Clerk of Council shall cause a notice of <br />the passage of this ordinance to be published once in a newspaper of general <br />circulation in this City and to continue on file in his office said revised <br />assessments. <br />Section 5. The Clerk of Council is hereby directed to deliver a <br />certified copy of this ordinance to the County Auditor within twenty days <br />after its passage. <br />Section 6. This ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety of said City and for the further reason that the immediate levy of <br />such assessments is necessary to permit the issuance of bonds to provide funds <br />to retire outstanding notes and thereby protect the credit of the City; where- <br />fore, this ordinance shall be in full force and effect from and immediately <br />after its passage and approval by the Mayor. <br />Passed <br />Attest: <br />2(A ,C.c CR_.J <br />Florence Holm, Clerk of Council <br />APPROVED: <br />Ra h E.
