CITY OF NORTH OIMSTED RESOLUTION N0. ° 14+ BY A RESOLUTION DECLARING THE NECESSITY OF CONSTRUCTING A CONCRETE SIDEWAIK ON THE EASTERLY SIDE OF DOVER CENTER ROAD BETWEEN LORAIN ROAD AND BU'ITERNUT RIDGE ROAD IN THE CITY OF NORTH OLMSTED? OHIO? AND DE- CLARING AN EMERGElYCY. BE IT RESOLVED by the Council of the City of North Olmsted, Cuya,hoga County, Ohio: Section 1. That it is necessary to improve Dover Center Road in the City of North Olmsted by constructing a concrete sidewalk on the easterly side of said street between Lorain Road and Butternut Ridge Road in accordance with the pla,ns hereinafter referred to and now on file in the office of the Clerk of Council. Section 2. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfaxe of said City and the inhabitants thereoi'. Section 3. That the grade of said street and improvement shall be the grade as shown by the pla.ns and profiles which have been prepared by the City Engineer and which are made a part hereof. Section 4. That the plans, specifications, esti.mates and profiles of the proposed improvement, heretofore prepared by the City Engineer and now on file in the office of the Clerk of Council, are hereby approved. Section 5. That the entire cost of said improvements, less 2% thereof to- gether with the cost of intersections, shall be assessed in proportion to the foot frontage of abutting property upon all lots and lands bounding and abutting upon both sides of Dover Center Road between Lorain Roa.d and Butternut Ridge Road, which said lots and lands are hereby determined to be specially benefited by said improvement. The cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles a.nd estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of pur- chasing, appropriating, and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obta.ining an approving legal opinion, cost of labor and material and interest on bonds and notes issued in anticipa.tion of the levy and collection of the special assessments together with all other necessary expenditures. Section 6. That the City Engineer be and he is hereby authorized a.n.d directed to parepare and file in the office of the Clerk of Council the estima,ted assessments of the cost of the improvement described in this resolution. Such es- timated assessments shall be based upon the estimate of cost of said improvement now on file in the office of the Clerk of Coun.cil and shall be prepared pursuant to the provisions of this reeolution. When such estimated assessments have been so filed, said Clerk shall cause notice of the adoption of this resolution and the filing of said esti.mated assessments to be served on the owners of all lots and lands to be assessed as provided in R C§ 727.13.
