? <br />s <br />CITY OF NORTH OLMSTID <br />RESOLUTION N0. <br />BY <br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE <br />SOUTHERN AVENtTE., DECKER ROAD AND MIDVALE AVENUE <br />IN THE CITY OF NORTH OLMSTED? OHIO, BY GRADING, <br />DRAINING, CURBIlVG, PAVSNGj, CONSTRUCTING SIDEWALKSJ' <br />APID INSTALLING SANITARY SEWER, STORM SEWER AND <br />WATER CURB CONNECTIONS WHERE NECESSARY, REP'EALTNG <br />RESOLUTION N0. 67-133, AND DECLARING AN EMERGENGY. <br />WHEREAS, this Council on June 6, 1967, adopted Resolution No. 67-133 <br />declaring the necessity of the improvement herein described; and <br />W'HEREAS, the estimate of cost for said improvement approved by <br />Resolution No. 67-133 was subsequently revised and Council deems it necessary <br />to adopt a new resolution declaring the necessity of the improvement described <br />in Section 1 hereof in wiew of the filing of a new estimate of cost; <br />NOW.. THEREF'ORE., BE IT RESOLVID by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, three-fourths of all members elected thereto <br />concurring: <br />Section l. That it is necessary to improve Southern Avenue from <br />a point 140 west of the westerly li.ne of Decker Road easterly to Burns Road, <br />Decker Road from Southern Avenue to Midvale Avenue, and Midvale Avenue from <br />Decker Road to Burns Road by grading, draining, curbing, paving, constructing <br />sidewalks, and installing sanitary sewer, storm sewer and water curb connec- <br />tions where necessary, as shown on the plans hereinafter referred to and now <br />on file in the office of the Clerk of Council. <br />Section 2. It is hereby determined and declared that said improve- <br />ment is conducive to the public health, convenience and welfare of said City <br />and the inhabitants thereof. It is hereby further determined that said <br />streets are so situated in relation to each other that in order to complete <br />the improvement thereof i.n the most practical and economical manner they <br />should be improved at the sam ti.me, with the same kind of materials., and in <br />the same man.ner, and shall therefore be treated as a single improvement in <br />accordance with Revised Code Section 72'7.09. <br />Section 3. That the grade of said streets and improvement shall <br />be the grade as shown by the plans and profiles which are made a part hereof. <br />Section 4. That the plans, specifications, estimates and profiles <br />of the proposed i.mprovement, heretofore prepared and now on file in the office <br />of the Clerk of Council are hereby approved. <br />Section 5. That the whole cost of said i.mprovement, less at least <br />2% thereof and the cost of intersections, shall be assessed in proportion to <br />the benefits which may result from the i.mprovement upon the following described <br />lots and lands, to wit: <br />All lots and lan.ds bounding ard abutting upon the proposed improve- <br />ment between the termini aforesaid, which said lots and lands are hereby <br />determined to be specially benefited by said i.mprovement; and the cost of <br />said improvement shall include the cost of preli.minary and other surveys, <br />plans, specifications, profiles and estimates and of printing, servi.ng and <br />publishing notices, resolutions and ordinances, the amount of damages resulting <br />from the improvement assessed in favor of any owner of land affected by the <br />i.mprovement and the interest thereon, the costs incurred in connection with
