CITY OF NORTH OLMSTED <br />RESOLUTION IVO. 68- <br />BY (,,0AJr,, ? <br />A RESOLUTION AUTHORIZIIVG THE MAYOR TO <br />EXEGUTE AN AGREEMENT WITH THE CUYAHOGA <br />COUNTY BOARD OF COUNTY COMMISSIONERS <br />FOR REPLACEMENT OF THE CTJLVERT LOCATED <br />ON BRADLEY ROAD ABOUT 670 FEET NORTH OF <br />BARTON ROAD, AIVD DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted and the Cuyahoga County "Board <br />of County Commissioners desire to enter into an agreement whereby a culvert <br />would be replaced on Bradley Road approximately 670 feet North of Barton Road <br />under certain terms and conditions ; and <br />WHEREAS, Council of the City of North Olmsted has been advised of a11 <br />the terms and conditions contained in said agreement including the contribution <br />to be made by the City of North Olmsted to the total cost of this project ; and <br />WHEREAS, it is Council's decision that the Mayor should enter into a <br />contract with the Cuyahoga County Board of County Commissioners for the re- <br />placement of this culvert. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1: That the Mayor be and he is hereby authorized to execute an <br />agreement with the Cuyahoga County Board of County Commissioners for the re- <br />placement of a culvert on Bradley Road situated approximately 670 feet North of <br />Barton Road in the City of North Olmsted. <br />Section 2: That Ordinance No. 65-115 is hereby repealed with the <br />effective date of this Resolution. <br />Section 3: That the Clerk of Council be and she is hereby instructed <br />to forward a certified copy of this resolution to the Cuyahoga County Board of <br />County Commissioners. <br />Section 4: That this Resolution is hereby determined to be an emergency <br />measure necessary forthe preservation of the public peace, health, safety and <br />welfare of the City by virtue of the fact that the present culvert has deteriorated <br />to a point of complete.failure, resulting in unsafe conditionfarthe traveling public. <br />WHEREFORE, this resolution shall take effect and be in force immedia#ely upon its <br />passage, otherwise, at the earliest period allowed by law. <br />PASSED: ?al Qi ATTEST: <br />? <br />324 10,1 ? <br />, Clerk of Council <br />P?CTi 0 Co <br />APPROVED: <br />Ralp E.
