CITY OF NQt TH OLMSTED <br />RESOLUTION NO. 68- Ilf <br />BY %J,0J?1?, Qn? <br />A RESOLUTIOIV DECLARING IT NECESSARY FOR COtTNCIL <br />TO APPROPRIATE EASEMENTS IN REAL PROPERTY FOR THE <br />CONSTRUCTION OF SWALES ON THE REAR PROPERTY LINE <br />OF SUBLOTS FACIN'G MICHAEL AVENUE, THE WESTERLY <br />SIDE OF THE STREET, AND DECLARING AIV EMERGENCY. <br />WHEREAS, Council has been advised by the City Engineer that a drainage <br />swale is necessary to alleviate flooding conditions on the Westerly side of Michael <br />Avenue ; and <br />WHEREAS, Council now wishes to construct swales for the drainage of <br />surface water on property in the Michael Avenue.: -- <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1: It is deemed necessary by the Council of the City of North <br />Olmsted, and Council hereby declares its intention to appropriate easements through <br />and to the extent necessary in the real property hereinafter described: <br />Sublot No. 10, Permanent Parcel No. 237-20-55, owned by <br />Mr. & Mrs. Wallace Matthei, iO foot easement parallel to <br />rear lot line from the Northerly lot line to the Southerly lot <br />line. <br />Section 2: That it is necessary for the City of North Olmsted to take <br />immediate possession of, and enter upon the property described as aforesaid to <br />facilitate the drainage of surface water. ' <br />Section 3: That the Mayor, be and he is hereby authorized and directed <br />to cause written notice of the passage of this Resolution to be given to the owners <br />of, or persons in possession of, or persons having an interest or record in the <br />above described real property or to their authorized agents and said notice shall <br />be served according to law by a person to be designated for the purpose by the <br />Mayor and to make return of such service in the manner provided by law. <br />Section 4: That this Resolution shall be declared an emergency . measure <br />necessary for the preservation of the public peace, health, safety and welfare of <br />the Cit-y by virtue of the fact that drainage of these areas will alleviate and dis- <br />continue a hazardous unhealthy aondition now existing.
