CITY OF NORTH OLMSTED <br />RESOLLTTION NO. 68-//0 <br />BY <br />A RESOLUTION DECLARING IT NECESSARY FOR COUNCIL <br />TO APPROPRIATE EASEMENTS IN REAL PROPERTY FOR THE <br />CONSTRUCTION OF SWALES ON THE REAR PROPERTY L INE <br />ON SUBLOTS FACING MICHAEL AVENUE, THE WESTERLY <br />SIDE OF THE STREET, AND DECLARING EN EMERGENCY <br />WHEREAS, Council has been advised by the City Engineer that a drainage <br />swale is necessary to alleviate flooding conditions on the Westerly side of Michael <br />Avenue; and <br />WHEREAS, Council wishes to contract swales for the drainage of surface <br />water on property in the Michael Avenue area. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. It is deemed necessary by the Council of the City of North Olmsted, <br />and Council hereby declares its intention to appropriate easements through and to the <br />extent in the real property hereinafter described: <br />Sublots No. 1& 2, Permanent Parcel No. 237-20-47, owned by P. Ebenger, <br />20 foot easement parallel to rear lot line from the Northerly lot line to the <br />Southerly lot line. <br />Sublot No. 6, Permanent Parcel No. 237-20-51, owned by J. & A. Backnick, <br />10 foot easement parallel to rear lot line from the Northerly lot line to the <br />Southerly lot line. <br />Sublot No. 7, Permanent Parcel No. 237-20-52, owned by W. & J. Cianciolo, <br />10 foot easement parallel to rear lot line from the Northerly lot line to the <br />Southerly lot line. <br />Sublot No. 8, Permanent Parcel No. 237-20-53, owned by John J. & M.J. <br />Elish, 10 foot easement parallel to rear lot line from the Northerly lot'line <br />to the Southerly lot line. <br />Sublot No.12, Permanent Parcel No. 237-20-57, owned by Robert J. & J.J. <br />Wilson, 10 foot easement parallet to rear lot line frcrm the Northerly lot line <br />to the Southerly lot line. <br />Sublot No. 17, Permanent Parcel No. 237-20-62, owned by Clementine; C. <br />Stafford, 10 foot easement parallel to rear lot line from the Northerly 2ot line <br />to the Southerly lot line. <br />For the purpose of constructing a swale for the drainage of surface water. <br />Section 2. That it is necessary for the City of North Olmsted to take im- <br />mediate possession of, and enter upon the property described as aforesaid to <br />facilitate the drainage of surface vvater. <br />Section 3. That the Mayor, be and he is hereby authorized and directed to <br />cause written notice of the passage of this Resolution to be given to the owners of, <br />or persons in possession of, or persons having an interest of record in the above <br />described real property or to thieir authorized agents and said notice shall be served <br />according to law by a person to be designated for the purpose by the Mayor and to
