CITY OF NORTH OLMSTED <br />BY ?22?Q .cJ <br />ORDINANCE N0. 68-11 <br />AN ORDI NANCE LEVYI NG SPECIAL ASSESSMENTS FOR THE 1MPROVEMENT OF CANTERBURY <br />ROAD AND SWEETBRIAR DRIVE BY CONSTRUCTING SANITARY SEWERS, SEWER CURB CON- <br />NECTIONS AND OTHER NECESSARY APPURTENANCES,, AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, <br />Ohio: <br />Section l. That the revised assessment of the cost and expense of irnproving <br />Canterbury Road and Sweetbriar Drive by constructing sanitary sewers, sewer <br />curb connections and other necessary appurtenances between the termini set <br />forth in Resolution No. 66-251, adopted September 20, 1966, amounting in the <br />aggregate to $110,555.93, as reported to this Council on the llth day of <br />January, 1968, by the City Engineer, and now on file in the office of the <br />Clerk of this Council, be and the same is hereby adopted and confirmed and <br />that there be and are hereby levied and assessed upon the lots and lands <br />bounding and abutting upon said improvement the several amounts reported <br />as aforesaid, which assessments are in proportion to the special benefits <br />and are not in excess of any statutory limitation. <br />Section 2. That this Council hereby finds and determines that the revised <br />assessments as now on file in the office of said Clerk of Council are in <br />the same amount as the original estimated assessments, Council having de- <br />termined that the City will assume as part of its share of the cost of the <br />improvement the amount by which the final cost exceeded the original esti- <br />mated cost of the improvernent. <br />Section 3. That the assessment against each lot or par.cel of land shall <br />be payable in cash within thirty days after the passage of this ordinance <br />or at the option of the owner in forty semi-annual installments with inter- <br />est at the same rate as shall be borne by the bonds to be issued in antici- <br />pation of the collection of the same. All cash payments shall be made to <br />the Director of Finance of this City. All assessments and installments <br />thereof remaining unpaid at the expiration of said thirty days shall be <br />certified by the Clerk of this Council to the County Auditor as provided <br />by law to be placed by him on the tax duplicate and collected as other taxes <br />are collected. <br />Section 4. That the Clerk of this Council shall cause a notice of the pas- <br />sage of this ordinance to be published once in a newspaper of general circulation <br />in this City and to continue on file in her office said revised assessments. <br />Section 5. The Clerk of this Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its <br />passage. <br />Section 6. That all ordinances or resolutions, or parts of ordinances or parts <br />of resolutions and especially Ordinance 67-262 inconsistent herewith to the <br />provisions of this ordinance, are hereby repealed with the effective date of <br />this ordinance. <br />Section 7. This ordinance is hereby declared to be an emergency measure nec- <br />essary for the immediate preservation of the public peace, health and safety <br />of said City and for further reason that the immediate levy of such assess- <br />ments is necessary to permit bonds to be issued to fund an outstanding note <br />of the City and thereby preserve the credit of the City; wherefore, this <br />ordinance shall be in full force and effect from and after its passage and <br />approval by the Mayor. <br />PASS ED : I? 6 0 <br />ATTEST: <br />Florence Holm, Clerk of Council <br />APPROVED : I ?G (G S <br />Ralph C.
