! <br />CITY OF NQRTH OLMSTED ORDINANCE NO. 68- ,, j PAGE 2 <br />Section 4: Upon completion of the work authorized by the permit <br />granted by compliance with the provisions of this ordinance, the contractor <br />shall make such temporary repairs as are necessary to maintain traffic and <br />shall promptly repair the roadway and/or right of way as sooon as possible. <br />In the event the contractor fails to make such repairs within ten ( 10 ) days <br />after notice from the City, the City may cause such repairs to be made and <br />the cost deducted from the deposits required by Section 1. <br />Section 5: When such work is completed to the satisfaction of the <br />City Engineer, the cost of inspection and supervision shall be forwarded on <br />to the Finance Department who shall deduct from the deposit, made by the <br />applicant, the cost incurred by the City and who shall issue a check to the <br />applicant for the return of the excess over and above the amount necessary <br />to reimburse the City for the cost of inspection and supervision. Where the <br />repair work is done by or under direction of the City, the cost of such work <br />shall be deducted from the deposit required under Section 1 together with <br />the cost of engineering and supervision. Any excess remaining after pay- <br />ment of charges for such work shall be returned to the applicant as provided <br />above. <br />Section 6: If the deposit be insufficient to reimburse the City, the <br />Engineering Department shall collect from the applicant a sufficient amount <br />to reimburse the City for the expense incurred. <br />Section 7: If the application is for a permit to open a street in <br />what is known as a"tree lawn " then the applicant shall make the $5.00 <br />payment for a permit and shall deposit with the Finance Department $15.00 <br />per square yard based on the size of the opening, as a guarantee that he will <br />restore the " tree lawn " to its original condition or pay the City for restoring <br />the same, which deposit, less the cost of inspection , shall be returned to <br />the person, firm or corporation making the same upon a certificate being is- <br />sued by the City Engineer that the tree lawn has been restored to the same <br />condition as before the opening was made. <br />who <br />Section 8: Any person, firm or corporation/shall make any openings <br />or remove the pavement in any street, boulevard, avenue or public ground of <br />the City of North Olmsted without having first obtained a permit from the <br />Engineering Department and having deposited with the City the estimated <br />cost of repairing said work of filing the bond hereinbefore set forth, shall <br />be guilty of a misdemeanor and upon conviction thereof shall be fined not <br />to exceed 'Ibvo Hundred and Fifty ($250 . 00 ) Dollars. <br />Section 9: Ordinance No. 2466, passed March 26, 1957, and all <br />other ordinances or part of ordinances inconsistent with the provisions of <br />this ordinance are hereby repealed. <br />Section 10 : That the Clerk of Council be and she is hereby directed <br />to mail a copy of this Ordinance to the Finance Department and Engineering <br />Department, <br />Section 11 : WHEREFORE, this Ordiaanee shall take effect and be <br />in force at the period allowed by Article IV, Section 12 of the Charter of the
