CITY OF NORTH OLMSTED <br />ORDINANCE NO. 68- fvz. <br />BY <br />AN ORDINANCE REPEALING CHAPTER 713, SECTION <br />713.01 to 713.99,PART 7, OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED, <br />OHIO, ENTITLED, "MOTELS AND MOTOR COURTS". <br />Whereas, Council has been advised by the Director of Law <br />that the State Of Ohio has by statute pre-empted the regulation of <br />motels and motor courts thereby withdrawing from municipal cor- <br />porations the right to license and to regulate motels and motor <br />courts, and <br />Whereas, Council further has been advised by the Director of <br />Law that the Supreme Court of Ohio has upheld the states exclusive <br />right to license and regulate motels and motor courts, and <br />Whereas, Council, upon the advice of the Director of Law now <br />wishes to remove from the Ordinances and Codified Ordinances all regula- <br />tions concerning motels and motor courts. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of North Olmsted, State of Ohio: <br />Section l. That Chapter 713, part 7 entitled "Motels and Motor <br />Courts" , Section 713. 01 throuqh Section 713. 99 inclusive are hereby repealed <br />with the effective date of this ordinance. <br />Section 2. That any part of Chapter 713 or any provision of or <br />any section contained in Chapter 713 pertaining to sanitation, the construc- <br />tion of building, drainage, compliance with zoninq laws, and the police <br />regulations, shall be governed by other ordinances of the City of North <br />Olmsted, pertaining to the specific regulations. <br />Section 3.
