CITY OF NORTH OLMSTID <br />RESOI,UTION N0. <br />BY <br />A RESOLUTTON DECLARING THE NECESSITY OF CONSTRUCTING <br />SIDEWALKS ON ESTHER AVENUE, VIRGSNIA AVENtTE AND <br />THERESA LANE IN THE CITY OF NORTH OLMS'.PED, OHIO? RE- <br />QUIR'ING THAT ABUTTING PROPERTY OWNERS CONSTRUCT THE <br />SAME, AND DECLARING AN ENIERGENCY. <br />BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio: <br />Seetion 1. That it is necessary to construct concrete sidewalks in <br />the City of North Olmsted, Ohio, in accordance with the pla.ns, specifications <br />and estimates of cost therefor prepared by the City Engineer and now on file <br />in the office of the Clerk of Council, and in the following locations: <br />1. Both sides of Esther Avenue from Clague Road easterly to the <br />North Olmsted City line. <br />2. Both sides of Virginia Avenue from Clague Road easterly to the <br />North Olmsted City line. <br />3. North side of Theresa Lane from Walter Road westerly 186 Peet <br />and the south side of Theresa Lane from Walter Road easterly <br />202 feet. <br />Section 2. That the pla.ns, specifications and estimate of cost for <br />said construction as heretofore filed be and the same are hereby approved. <br />Section 3. That the owners of all lots and lands bounding and <br />abutting upon the proposed sidewalks shall construct, in accordance with the <br />plans and specifications now on file, the portion of such sidewalks abutting <br />on their respective properties within a period of thirty days after service <br />of notice of the passage of this resolution; and, if such construction shall <br />not be completed within such period of thirty days, then this Council shall <br />have the same done a,nd the entire cost thereof shall be assessed upon the <br />property of each defaulting owner and made a lien thereon, to be collected <br />in the maxiner provided by law, with penalty and interest as provided by law. <br />Section 4. That the Clerk of this Council is directed to cause a <br />written notice of the passage of this resolution to be served on each affected <br />property owner?as required by law. <br />Section 5. That this resolution is hereby dec].ared to be an emergency <br />measure necessaxy for the immediate preservation of the public peace, health <br />and safety by virtue of the need for the immediate construction of such side- <br />walks to perm3.t safe passage by persons using said streets and to eliminate <br />existing hazard.s to pedestrians; wherefore, this resolution shall be in fla.ll <br />force and effect frm and immediately after its passage and approval by the <br />Mayor. <br />PASSID ? <br />ATTES • <br />C? <br />Florenee Holm, Clerk of Council <br />APPROVm: 9 to 9 <br />. <br />Ralph .
