? -? <br />, . ? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 69- f? <br />. <br />BY <br />AN ORDINANCE AMENDING SECTION 533.07 PARAGRAPHS A AND <br />B( CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ) OF <br />ORDINANCE NO. 68-196, ENACTED NOVEMBER II, 1968, AND EN- <br />TITLED " AN ORDINANCE ENACTING SECTIOIV 533.07, " INHALING <br />TOXZC VAPORS, " AND DECLARING AN EMERGEIVCY. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That Section 533.07, Chapter 533, Part 5 of the ( Codified <br />Ordinances ) City of North Olmsted General Offenses Code reading as follows: <br />Section 533.07 Inhalina Toxic Vapors <br />( a) " It is unlawful for any person deliverately to smell or <br />inhale any drug, or any other noxious substances or <br />chemicals containing any ketones, aldehydes, organic <br />acetates, ether, chlorinated hydrocarbons, or any other <br />substances containing solvents releasing toxic vapors <br />in such excessive quantities as cause conditions of <br />intoxication, inebriation, excitement, stupefaction or <br />dulling of the brain or nervous system. This section <br />applies with particularity to but not limited to finger <br />nail polish, model airplane glue, or any other sub- <br />stance or chemical which has the aforementioned effect <br />upon the brain or nervous system when smelled or in- <br />haled. <br />( b) Notwithstanding the general penalty provided in the <br />Chapter, any person violating this section shall be guilty <br />of a misdemeanor and upon conviction thereof, shall be <br />fined not less than $25.00 nor more than $?:fl0.00 for the <br />first offense, and not less than $50.00 nor more than <br />$200.00 and be imprisoned not more than six ( 6) months <br />or both for each subsequent offense. " <br />be and the same is hereby amended to read as follows: <br />Section 533.07 Inhalincr Toxic Vapors <br />( a) It is unlawful for any person deliberately to smell or <br />inhale any drug, or any other noxious substances or <br />chemicals containinq any ketones, aldehydes, organic <br />acetates, ether, chlorinated hydrocarbons, or any other <br />substances containing solvents releasing toxic vapors <br />so as to induce intoxication, inebriation, excitement, <br />stupefaction or dulling of the brain or nervous system. <br />This section applies with particularity to but not limited <br />to finger nail polish, model airplane glue, or any other <br />substances or chemical which has the aforementioned <br />effect upon the brain or nervous system when smelled <br />or inhaled.
