CITY OF NORTH OLMSTED <br />RESOLUTION N0. 69-111 <br />BY p Yrl, . <br />A RESOLUTION OPPOSING THE APPLICATION FOR A <br />LIQUOR PERMIT WITHIN THE CITY OF NORTH OLMSTED <br />BY LUDWIg'S DRIVE-IN, INC., DBA CARRIAGE MANOR, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Section 4303.261 of the Ohio Revised Code <br />the North Olmsted Legislative Authority was notified of the applica- <br />tion No. 5342613 for a D3 permit in the name of Ludwig's Drive-In <br />Inc., DBA Carriage Mannr, 23370 Lorain Road, North Olmsted, Ohio; <br />and <br />WHEREAS, Section 4303.261 of the Ohio Revised Code provides <br />for the Legislative Authority to object to the issuance of an <br />application for a liquor permit within 30 days of the date of the <br />notification of such application. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section l. That the Council of the City of North Olmsted, Ohio <br />does hereby exercise its right to object to the issuance of a D3 <br />permit applied for under application No. 5342613 by Ludwig's Drive-In <br />Inc., dba Carriage Manor, 23370 Lorain Rd., North Olmsted, Ohio, and <br />does direct the Clerk of Council to send by certified mail: <br />l. Two certified copies of this Resolution of Objections; and <br />2. Two signed statements in writing, listing the reasons for <br />the objections, <br />and requests that the Department of Liquor Control set a time and date <br />for a member of this Council to be heard on this matter. <br />Section 2. That this Resolution is hereby declared to be an emer- <br />gency measure necessary for the preservation of the public peace, health, <br />safety and welfare of the City by virtue of the fact that the Ohio Re- <br />vised Code provides for the Legislative Authority to object to the issu- <br />ance of an application. 14HEREFORE, this Resolution shall take effect <br />and be in force immediately upon its passage, otherwise, at the earliest <br />period allowed by law. <br />PASSED 10469 <br />ATTEST: <br />r <br />L??' <br />Florence Holm, Clerk of Council Francis J. 0`Ne' 1, President of Council <br />_ <br />APPROVED : 9 <br />?- <br />? <br />Ralph .
