<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 69-/04 <br />BY <br />AN ORDINANCE AMEN'DING THE GEIVERAL OFFENSES CODE <br />OF THE CITY OF NORTH OLMSTED, OHIO, SECTION 545.99 <br />( CODIFIED ORDINANCES ), ENTITLED " PENALTY, " TO CON- <br />FORM TO CHANGES ENACTED BY TI-E OHIO GENERAL ASSEMBLY, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be re- <br />viewed to eliminate any conflicts with provisions of the State Statutes, as en- <br />acted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the' City of <br />North Olmsted, State of Ohio : <br />Section l. That Section 545.99, Chapter 545 ( Codified Ordinances ) <br />of the North Olmsted General Offenses Code reading as follows: <br />545.99 PENALTY. <br />" Whoever violates any provisions of this chapter shall be <br />fined not more than one hundred dollars ($100. 00 ) or im- <br />prisoned not more than thirty days, or both. " <br />be and the same is hereby amended to read as follows: <br />545.99 PENALTY. <br />( a) Whoever violates any provisions of this chapter, <br />where no other penalty is otherwise provided, shall <br />be fined not more than one hundred dollars ($100.00 ) <br />or imprisoned not more than thirty days, or both. <br />( b) Whoever violates Section 545.08 shall be fined not <br />more than five hundred dollars ($500.00 ) or im- <br />prisoned not more than one year, or both. <br />Section 2. That any ordinance or parts of ordinances, or resolution or <br />parts of resolutions, inconsistent with the provisions of this Ordinance, are here- <br />by repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virture of the fact that Section 545.99 prior to this amend- <br />ment is in conflict with the provisions of the State Statutes.
