"`,Z <br />By /n , <br />-•'k----&42 r4?? <br />AN ORDINANCE I,EVYING SPEC]"AL ASSESSMENTS FOR <br />THE CONSTRUCTION OF SIDEWALKS ON DAVID DRIVE AND <br />CERTAIIV OTFiER STREETS, AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio: <br />Section 1: That the assessment of the cost and expense of construct- <br />ing sidewalks at the locations on David Drive, Tree Lane, Woodview Drive, <br />Sharon Drive, Delmere Drive, Forest Ridge, Park Ridge, Fawn Drive, Chase Drive, <br />Dawn Drive, and Deerfield Drive as set forth in Resolution No. 67-101, adopted <br />March 21, 1967, where such sidewalks were not constructed by the abutting <br />property awners pursuant to the option offered by said resolution, amounting <br />in the aggregate to $9,233•24, as heretofore reported to this Council by the <br />City Engineer, notice of the filing of which assessments has been given as <br />required by law, be and the same is hereby adopted and confirmed, and that <br />there be and are hereby levied and assessed upon the lots and lands bounding <br />and abutting upon said improvement the several amounts reported as aforesaid, <br />which assessments and the description of said lots and lands are now on file <br />in the office of the Clerk of this Council and which assessments are not in <br />excess of the special benefits or in exces¢, of any statutory limitation; that <br />the objection to such assessments filed byMt`.Frankl_inis found to be without <br />merit and is hereby overruled; and that thg object of Mr. Robert Madow has <br />subsequently been withdrawn. <br />Section 2: That the assessment against each lot or parcel of land <br />shall be payable in cash within thirty days after the passage of this ordi- <br />nance or at the option of the owner in ten semi-annual installments with inter- <br />est at the same rate as shall be borne by the bonds to be issued in anticipa- <br />tion of the collection of the same. Al1 cash payments shall be made to the <br />Director of Finance of this City. A11 assessments and installments thereof <br />remaining unpaid at the expiration of said thirty days shall be certified by <br />the C1erk of this Council to the County Auditor as provided by law to be <br />placed by him on the tax duplicate and collected as other taxes are collected. <br />Section 3: That the Clerk of this Council shall certify a copy of <br />this ordinance to the County Auditor within twenty days after its passage. <br />Section 4: This ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety of said City, and for the further reason that the im¢nediate levy <br />of these assessments is necessary to permit bonds to be issued to fund the <br />outstanding note issued in anticipation of the bonds and thereby protect the <br />credit of the City; wherePore, this ordinance shall be in full force and <br />effect from and immediately after its passage and approval by the Mayor. <br />Passed: oil 12T <br />Attest <br />Florence Holm, Clerk of Council <br />Approved: ?
