_..µ?.. ,._ _,..A.,.. <br />m_ <br />. , <br />CI TY OF NORTH OLMSTED <br />ORDINANCE N0. <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE IMPROVEMENT <br />OF GREAT NORTHERN BOULEVARD IN THE CITY OF NORTH OLMSTED, <br />OHIO, BETWEEN CERTAIN TEFMNI BY INSTALLING STORM AND SANITARY <br />SEWERS AND WAZrER MAIN, SEWER AND WATER CtTRB CONNECTIONS, TO- <br />GETHER WITH ALL NECESS.ARY APPURTENANCES, AND DECLARING AN <br />IlytERGENCY. <br />BE IT ORDAINE'D by the Council of the City of 1Vorth Olmsted, Cuyahoga County, <br />Ohio: <br />Section 1. That the revised assessment of the cost and expense of improving <br />Great Northern Boulevard from Lorain Road to Brookpark Road by installing storm <br />and sanitary sewers and water main, sewer and water curb connections, together <br />with all necessary appurtenances, amounting in the aggregate to $104,492.41, as <br />reported to this Council on the 7th day of January, 1969, by the Engineer of <br />this City and now on file in the office of the Clerk of Council, be and the same <br />is hereby adopted and confirmed a.nd that there be a,nd are hereby levied and <br />assessed upon the lots and lands bounding and abutting upon said improvement <br />the several amounts reported as aforesaid, which assessments are in proportion <br />to the special benefits and are not in excess of any statutory limitation. <br />Section 2. That this Council hereby finds and determines that the revised <br />assessments as now on file in the affice of said Clerk are in the same proportion <br />to the estimated assessments as originally filed as the actual cost of the above <br />described improvement is to the estimated cost of the improvement as originally <br />filed. <br />Section 3. That the assessment against each lot or parcel of land shall be <br />payable in cash within thirty days after the passage of this ordinance or at the <br />option of the owner in forty semi-annual installments with interest at the same <br />rate as shall be borne by the bonds to be issuecl in anticipation of the collection <br />of the same. All cash payments shall be made to the Director of Finance of this <br />City. All assessments and installments thereof remaining unpaid at the expira- <br />tion of said thirty days shall be certified by the Clerk of Council to the County <br />Auditor as provided by law to be placed by hi.m on the tax duplicate and collected <br />as other taxes are collected. <br />Section 4. That the Clerk of Council shall cause a notice of the passage of <br />this ordinance to be published once in a newspaper of generalcirculation in this <br />City and to continue on file in his office said revised assessments. <br />Section 5. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the Cou.nty Auditor within twenty days after its passage. <br />Section 6. This ordinance is hereby declared to be an emergency measure <br />necessary for the ilmnediate preservation of the public peace, health and safety <br />of said City and for the further reason that the immediate levy of such assess- <br />ments is necessary to permit the issuance of bonds to provide funds to xetire <br />an outstanding note and thereby protect the credit of the City; wherefore, this <br />ordinance shall be in full force and effect from and immediately after its passage <br />and approval by the Mayor. <br />Passe ? <br />Attestll?A?L,S,.,r % 1 / V <br />Florence Holm, Clerk of Council Francis J. 0`Neill Pr . of Council <br />. <br />APPROVED: <br />Ra,lph .
