ORDINANC E NO. 69-,6Z <br />BY , <br />AN ORDINANCE AMENDIIVG THE GENERAL OFFENSES CODE <br />OF THE CITY OF NORTH OLMSTED, OHIO, SECTION 509.06 <br />( CODIFIED ORDINRNCE ), ENTITLED " RIOT ", TO CONFORM <br />TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, <br />AND REPEALING ORDINANCE NO. 65-296, SECTION 509.06 <br />( CODIFIED ORDINANCE ), AIVD DECLARING P;N EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest <br />of the City of North Olmsted that the North Olmsted General Offenses Code <br />be reviewed to eliminate any conflicts with provisions of the State Statutes, <br />as enacted by the Ohio General Assemblg. <br />NOW,THEREFORE, BE IT ORDAINED by the Council of the City <br />of North Olmsted, State of Ohio : <br />Section l. That Section 509.06, Chapter 509 ( Codified Ordinance ) <br />of the North Olmsted General Offenses Code reading as follows: <br />509.06 RIOT <br />No person shall assemble with two or more other persons <br />to do an unlawful act with force and violence, or do such <br />unlawful act or agree with each other to do so and make <br />preparation or movement therefor. No person shall con- <br />tinue together with two or more other persons after pro- <br />clamation is made by the police officers, as provided in <br />Ohio R. C. 3761.14, demanding them in the name of the <br />City to disperse and depart, or is prevented from so being <br />made by rioters. ( ORC 3761.13 ) <br />be and the same is hereby amended to read as follows: <br />509.06 DISPERSING OF RIOTOUS GROUP <br />Where five or more people are engaged in violent or tumultuous <br />conduct which creates a clear and present danger to the safety <br />of persons or property, a law enforcement officer, or com- <br />missioned officer of the organized militia or armed forces of <br />the United States called to duty to protect against domestic <br />violence, shall, forthwith upon view or as soon as may be on <br />information, and unless prevented by such persons, order <br />such persons to desist and disperse to their several homes or <br />lawful employments. Such order shall be given by such means <br />and as often as necessary to reasonably insure that it is <br />heard, unless the giving or hearing of such order is prevented <br />by such persons.
