<br />1* <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 69- ?g <br />BY G <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE <br />CITY OF NORTH OLMSTED, OHIO, SECTION 333.05 <br />(CODIFIED ORDINANCE), ENTITLED "EMERGENCY <br />VEHICLES EXCEPTED FROM SPEED LIMITATIONS," TO <br />CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL <br />.. ASSEMBLY, AND DECLARING AN EMERGENCX. <br />WHEREAS, Council has determined that it is in the best <br />interest of the City of North Olmsted that the North Olmsted <br />Traffic Code be reviewed to eliminate any conflicts with pro- <br />visions of the State Statutes, as enacted by the Ohio General <br />Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of <br />the City of North Olmsted, State of Ohio: <br />Section l. That Section 333.05, Chapter 333 (Codi- <br />fied Ordinance) of the North Olmsted Traffic Code reading as <br />follows: <br />333.05 EMERGENCY VEHICLES EXCEPTED FROM SPEED <br />LIMITATIONS. <br />"The prima facie speed limitations set forth <br />in Section 333.03 do not apply to emergency <br />vehicles when they are responding to emer- <br />gency calls and when the drivers thereof <br />sound audible signals by bell, siren, or <br />exhaust whistle. This section shall not <br />relieve the driver of an emergency vehicle <br />from the duty to drive with due regard for <br />the safety of all nersons using the street <br />or highway." <br />be and the same is hereby amended to read as follows: <br />333.05 SPEED EXCEPTIONS FOR EMERGENCY OR <br />SAFETY VEHICLES. <br />The prima-facie speed limitations set forth in <br />Section 333.03 do not apply to emergency <br />vehicles or public safety vehicles when they <br />are responding to emergency calls, and when the <br />drivers thereof sound audible signals by bell, <br />siren or exhaust whistle. This section does <br />not relieve the driver of an emergency vehicle <br />or public safety vehicle from the duty to drive <br />with due regard for the safety of all persons <br />using the street or highway. <br />Section 2. That any ordinance or parts of ordinances, <br />or resolutions or parts of resolutions, inconsistent with the <br />provisions of this Ordinance, are hereby repealed with the <br />effective date of this Ordinance.
