.? <br />? <br />ORDINAIVCE NO. 69-?? <br /> I <br />BY .J <br />AN ORDINANCE ENACTING SECTION 509.065 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, ( CODIFIED ORDINANCES ), EN- <br />TITLED " SECOIVD DEGREE RIOT, " TO CONFORM TO <br />CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be <br />reviewed to eliminate any conflicts with provisions of the State Statutes, as <br />enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That Section 509A'065, Chapter 509 ( Codified Ordinances ) <br />of the N'orth Olmsted General Offenses shall read as follows: <br />509.065 SECOND DEGREE RIOT. <br />No person shall participate with four or more others in <br />violent and tumultuous conduct : <br />( a) With intent to do a lawful act with unlawful force and <br />violence in such a manner as to create a clear and pre- <br />sent danger to the safety of person or property ; <br />( b) With intent to prevent or coerce official action, or to <br />hinder, impede or obstruct a function of government ; <br />( C) With intent to commit or facilitate the commission of a <br />misdemeanor. <br />Section 2. That any ordinance or parts of ordinances, or resolution or <br />parts of resolutions, inconsistent with the provisions of this Ordinances, are <br />hereby repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the public <br />peace, safety, health and welfare by virtue of the fact that Section 509.065 <br />prior to this amendment is in conflict with the provisions of the State Statutes. <br />WHEREFORE, this Ordinance shall take effect and be in force immediately upon <br />its passage, otherwise, at the earliest period allowed by law. <br />PASSED: / l9 <br />ATTEST: <br />.dl D?1 <br />Florence Holm, Clerk of Council <br />. <br />Francis J.
