CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-145 <br />BY: JAMES BOEHMER <br />AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS <br />PERSONAL PROPERTY OWNED BY THE CITY OF NORTH <br />OLMSTED AND PREVIOUSLY USED BY THE DEPARTMENT <br />OF PUBLIC SAFETY, NAMELY, THE POLICE DEPARTMENT, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Police Department has in its possession, the <br />following equipment which has been replaced by newer and more updated <br />equipment, and thus is no longer necessary for the operation of the <br />Police Department: <br />1 - Police Communication Repeater. <br />6 - Police Mobile Radios. <br />and, <br />WHEREAS, it is the desire of this Council to authorized the <br />Director of Public Safety to sell this surplus equipment to another <br />governmental entity, and <br />WHEREAS, it is not deemed to be necessary to advertise for <br />bids regarding this equipment, in that it is being sold to another <br />governmental entity. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the Director of Public Safety be, and he is <br />hereby auorize?c, to sell to another governmental entity, one (1) <br />Police Communication Repeater, and six (6) Police Mobile Radios, <br />at the best possible price obtainable. <br />SECTION 2: That the Mayor be and he is hereby authorized to <br />enter into an agreement with another governmental entity for the <br />sale of the aforesaid personal property to the highest bidder, and <br />further that upon execution of said agreement and prior to delivery <br />of said equipment, that the highest bidder pay in cash to the City <br />of North Olmsted one hundred percent (1000) of the bid price. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public health, safety and welfare and for the further reason it is <br />immediately necessary to sell the aforesaid surplus equipment, for <br />not only the purpose of preserving the value thereof, but also making <br />room for the present equipment, and further provided it receives <br />the affirmative vote of two-thirds of all the members elected to <br />Council, it shall take effect, and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED: <br />ATTEST: <br />FtORENCE CAMPBELL, Q&ERK OF COUNCIL .
