Ir <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-12£3 <br />6 Y : _----???_--- ? _ <br />AN ORDINANCE DIRECTING THE MAYOR OF <br />THE CITY OF NORTH OLMSTED, OHIO, TO <br />REQUEST THE CUYAHOGA COUNTY ENGINEER'S <br />OFFICE TO INCLUDE IN THEIR PLANS FOR <br />IMPROVING CLAGUE ROAD IN THE CITY OF <br />NORTH OLMSTED, OHIO, CERTAIN <br />DRAINAGE ITEMS AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, on October 4, 1977 the Council of the City of <br />North Olmsted, Ohio, adopted Ordinance No. 77-166 cooperating with the <br />County in plans for improving Clague Road C.R. 52; from Lorain Road to the <br />North Olmsted North Corporation Line; and <br />WHEREAS, the Council of the City of North Olmsted has <br />requested and directed its City Engineer, to prepare the necessary plans, <br />specifications and profiles for the resurfacing, restoration and rehabilitation <br />of Clague Road which plans include certain roadway drainage items; and <br />WHEREAS, the City Engineer submitted said plans to the <br />Cuyahoga County Engineer on March 18, 1980 & September 30, 1981, and which <br />plans have been reviewed by the County Engineer's Office; and <br />WHEREAS, the City of North Olmsted requests that the <br />drainage shown on said plans for the resurfacing, restoration and <br />rehabilitation of Clague Road be included in the improvements, and that <br />the City of North Olmsted will pay that portion of the drainage improvements <br />as shown on said plans which are determined by the County not eligible <br />for County funding. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor of the City of North Olmsted <br />be and he hereby is authorized and directed to request the Cuyahoga County <br />Engineer's Office to include in their plans for the improvement of Clague <br />Road C.R. 52, that portion of the roadway drainage as shown on the preliminary <br />plans for resurfacing, restoration and rehabilitation of Clague Road <br />submitted to the Cuyahoga County Engineer's Office on March 18, 1980 and <br />September 30, 1981, which are determined by the County to be ineligible <br />for County $5.00 License Tax Funding, the entire cost of which ineliaible <br />drainage improvements the City of North Olmsted agrees to pay. <br />SECTION 2: That this ordinance is hereby declared to be <br />an emergency measure necessary for the immediate preservation of the public <br />health, safety and welfare of the City of North Olmsted, such necessity <br />existing for the reason that such improvements of Clague Road are direly <br />needed and to have the County Commissioners include the drainage in with <br />their plans for the resurfacing, restoration and rehabilitation of the road; <br />wherefore, this ordinance shall take effect and be in force immediately upon <br />its passage and approval of the Mayor, otherwise, from and after the earliest <br />period allowed by law. <br />PASSED: <br />ATTEST: <br />_ ?• ? <br />?.. 4 <br />FL RENCE CAMPBELL, CLERK F COUNCIL JAME W€?F-b.--??A4P?R?', PRESIDENT OF <br />S D.
