? <br />N <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-127 <br />B Y .- , Z&,? <br />-? - <br />AN ORDINANCE DIRECTING THE MAYOR OF THE CITY <br />OF NORTH OLMSTEC, OHIO, TO REQUEST THE CLYAHQGA <br />COUNTY ENGINEER'S OFFICE TO INCLUDE IN THEIR <br />PLANS FOR IMPROVING DOVER CENTER ROAD IPd THE <br />CITY OF NORTH OLMSTED, OHIO, CERTAIN DRAINAGE <br />ITEMS, SIDEWALKS ON THE EAST SIDE AND <br />CONCRETE DRIVEWAY APRONS, AND DECLARING <br />AN EMERGENCY. • <br />WHEREAS, on July 3, 1979 the Council of the City of North <br />Olmsted, Ohio, adopted Ordinance No. 79-79 cooperating with the County in <br />pluns for 4improving Dover Center Road C.R. 58, Butternut Ridge Road to North <br />Olmsted North Corporation Line, and <br />WHERFAS, the Council of the City of North Olmsted has <br />requested and directed its Consulting Engineer, John David Jones, to prepare <br />the necessary plans, specifications and profiles for the resurfacing, <br />restoration and rehabilitation of Dover Center Road which plans include certain <br />roadway drainage items, sidewalks on the east side and concrete driveway, aprons, <br />and <br />WHEREAS, the Consulting Engineer submitted said plans to the <br />Cuyahoga County Engineer on March 6, 1981, and which plans have been revie!ved <br />by the County Engineer's Office; and <br />WHEREAS, the City of North Olmsted requests that the drainage, <br />sidewalks and driveway aprons shown on said plans for the resurfacing, <br />restoration and rehabilitation of Dover Center Road be included in the <br />improvements, and that the City of North Olmsted will pay that portion of the <br />drainage improvements, sidewalks and driveway aprons as shown on said plans <br />which are determined by ±he County not eligible for County funding. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the Mayor of the City of North Olmsted be <br />and he hereby is authorized and directed to reauest the Cuyahoga County <br />Engineer's Office to include in their plans for thE improvement of Dover Center <br />Road C.R. 58, that portion of the roadway drainage, sidewalk and concrete <br />driveway aprons as shown on the preliminary plans for resurfacing, restoration <br />and rehabilitation of Cover Center Road submitted to the Cuyahoga County <br />Engineer's Office on March 6, 1981, which are determined by the County to be <br />ineligible for County $5.00 License Tax Funding, the entire cost of which <br />ineligible drainage improvements, sidewalks and concrete driveway aprons the <br />City of North Olmsted agrees to pay. <br />SECTION 2: That this ordinance is hereby declared to be <br />an emergency measure necessary for the immediate preservation of the public <br />health, safety and welfare of the City of PJorth Olmsted, such necessity <br />existing for the reason that such improvements of Dover Center Road are direly <br />needed and to have the County Commissioners include the drainage, sidewalks and <br />concrete drivewav aprons in with their plans for the resurfacinq, restoration <br />and rehabilif;ation of the road; wherefore, this ordinance shall take effect <br />and be in force immediately upon its passage and approval of the Mayor, <br />otherwise, from and after the earliest period allowed hy law. <br />PASSED: <br />ATTEST: <br />ORENCE CAMPBELL, CLERK F COUNCIL <br />? <br />6dE?f-H:-L4M <br />T, PRESIDENT OF <br />1PER <br />ZP?S S D.
