CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81 - 117 <br />BY: MR. LOGAN <br />? <br />AN ORDINANCE GRA?VTING CERTAIN POWERS TO <br />THE DIRECTOR OF PUBLIC SAFETY WITH RESPECT <br />TO THE CONTROL OF ALL ELECTRICAL CAPACITORS <br />NO?N LOCATED IN THE CITY OF NORTH OLMSTED WHICH <br />MAY BE CONSTITUTING A HAZARD TO THE GENERAL <br />PUBLIC, AND DECLARING AN EMERGENCY. <br />WHEREAS, it has been determined that the Cleveland Electric <br />Illuminating Company has installed on its transmission facilities <br />located within the City of North Olmsted certain electrical capaci- <br />tors which contain polycholorinated biphenyls (P.C.B.), and <br />WHEREAS, it has been determined by the Environmental <br />Protection Agency that P.C.B. constitutes a potential threat to the <br />health and well being of the public, and <br />WHEREAS, it has been made known to the Council of the City <br />of North Olmsted that certain electrical capacitors in other <br />sections of Cuyahoga County have become defective, have leaked or <br />exploded, and created a real and present danger of persons coming in <br />contact with the P.C.B. contained therein, and <br />WHEREAS, it has been determined by the Council of the City of <br />North Olmsted that there are several such electrical capacitors <br />situated on the public ways in the City and which constitute a real <br />and present danger to the well being of the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council of the City of North Olmsted, <br />for and on behalf of its citizens, directs the Director of Public <br />Safety to determine which poles containing P.C.B. capacitors within <br />the City of_ North Olmsted constitute a potential threat to the health <br />and well being of the public. This Council further directs the <br />Director of Public Safety to complete said determination and to <br />submit to the Clerk of North Olmsted City Council, by November 4, <br />1981, a written report of his findings which shall include but <br />shall not be limited to: 1) the nhysical condition of said poles, <br />and 2) the location of said poles within the City of North Olmsted. <br />SECTION 2: That this Council does hereby empower the <br />Director of Public Safety to order the Cleveland Electric Illuminating <br />Comnany to remove any such hazardous capacitors from any location <br />as soon as it is reasonably possible to do so. The determination of <br />reasonable time and the determination of potential hazard created <br />by a P.C.B. capacitor shall be made by the Director of Public Safety.
