<br /> <br />CITY OF NORTH OLMSTED <br />QRDINANCE N0. 81- 110 <br />BY: DEAN McKAY <br /> <br />AN ORDINANCE AMENDING SECTION 741.03 OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED, ENTITLED <br />"PROHIBITIONS" OF CHAPTER 741, ENTITLED "DELIVERIES <br />TO COMMERCIAL ESTABLISHMENTS", AS AT4ENDED. <br />WHEREAS, recently there have been numerous complaints with <br />respect to vehicles being left standing in a running condition <br />while deliveries are being made to commercial establishments, and <br />WHEREAS, the exhaust fumes created by standing vehicles <br />that are in one position for a length of time constitutes not <br />only a health hazard because of the noise and fumes, but also <br />constitutes an annoyance which need not be tolerated by residence <br />abutting up against commercial establishments, and <br />WHEREAS, it is the desire of this Council to amend Section <br />741.03 to provide therein that vehicles which are waiting to load <br />are loading or unloading be required to turn off the engine of <br />the vehicle during said periods of time. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Section 741.03 of the Codified Ordinances <br />of the Clty No orth Olmsted entitled "Prohibitions" of Chapter 741, <br />entitled "Deliveries to Commercial Establishments" which now reads: <br />741.03 PROHIBITIONS. <br />"No person shall deliver or cause to be delivered, <br />or accept delivery of, any goods or merchandise to <br />or at a commercial establishment within 250 feet of <br />a residential building between the hours oL 11:00 P.M. <br />and 7:00 A.M." <br />be and the same is hereby amended and as amended shall read as <br />follows: <br />741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, <br />or accept delivery of, any goods or merchandise to or <br />at a commercial establishment within 250 feet of a <br />residential building between the hours of 11:00 P.M. <br />and 7:00 A.M." <br />(b) No person making deliveries or receiving deliveries <br />at any time shall permit the engine of a motor vehicle <br />to remain running for more than ten (10) minutes while <br />waiting to make or receive deliveries. <br />SECTION 2: That Section 741.03 as previously adopted is <br />hereby repea e with the effective date of this Ordinance.
